    Notice is hereby given by the Administrative Law Judge that this matter was set for rehearing under Section 10-113 of the Public Utilities Act by Order of the Commission on February 20, 2014. The order granting the rehearing set aside a stipulation to dismiss entered by the Commission after a written filing by Mr. LaVigne objecting to the terms of a settlement that he had signed off on.
    That same Section of the Act states that if the Commission “shall fail to enter a final order upon rehearing within 150 days after such rehearing is granted, the application for rehearing shall be deemed to have been denied and finally disposed of, and an order to that effect shall be deemed to have been served, for the purpose of an appeal from the rule, regulation, order or decision covered by such application.” The expiration of the 150 day rehearing period occurs on July 20, 2014. Complainant failed to appear at the hearing set by the Clerk of the Commission for April 24, 2014. The Complainant has indicated in writing that he does not intend to appear and wishes to resolve this matter by fax. Counsel for the Respondent ComEd moved at that hearing for an Order dismissing this case for want of prosecution. That Motion was taken under advisement by the ALJ. The Complainant is hereby notified that he can withdraw, abandon, prosecute or settle his complaint as he chooses, but if he does not resolve it within the statutory time period, it will be dismissed by operation of law. In order to allow adequate time to prepare the appropriate order this matter is reset to June 12, 2014 at 11:00 A.M. Notice served electronically to parties.
