Service - Administrative Law Judge Ruling

Notice is hereby given by the Administrative Law Judge that on February 27, 2013, Prairie Point Energy, L.L.C. d/b/a Nicor Advanced Energy ("Nicor") filed a Motion for Protective Treatment seeking to have portions of its 2012 Dekatherm Report filing (the “filing”) as an Alternative Gas Supplier protected from public disclosure for a period of not less than two years. On June 18, 2013, an Order was entered by the Illinois Commerce Commission (“Commission”) granting a two year period of confidential treatment. On February 9, 2015, Nicor filed a Motion to Extend the Protective Order previously entered for five years from the date of the original filing. On April 1, 2015, the Commission reopened this proceeding to consider the request for an extension.
Nicor is directed to make an additional filing within 21 days of the date of this ruling explaining why it believes a five year period of confidential treatment is needed, and why the initial two year period of confidential treatment was insufficient to protect the interests of Nicor. Nicor should address specifically how disclosure of this information could cause competitive harm to Nicor’s operations. Notice served electronically to parties.
