Please explain why the construction of this transmission line can not be considered on a standalone basis in a separate docket. In order to reduce the number of issues to be resolved under the shortened statutory deadline, would ATXI be willing to withdraw the Sidney to Rising portion of its Illinois Rivers Project? If not, please explain why. 2) Why is the construction of a 345 kV transmission line between Ipava and Meredosia, Illinois part of the Illinois Rivers Project? Please explain why the construction of this transmission line can not be considered on a standalone basis in a separate docket. In order to reduce the number of issues to be resolved under the shortened statutory deadline, would ATXI be willing to withdraw the Ipava to Meredosia portion of its Illinois Rivers Project? If not, please explain why. ATXI’s response to each of these questions must be filed by December 19, 2012. Notice is further given by the Administrative Law Judges that because a lack of legal authority to construct a transmission line along the proposed primary route would render the efforts to analyze the suitability of the proposed primary route meaningless, Ameren Transmission Company of Illinois (“ATXI”) is hereby directed to file a legal brief no later than April 23, 2013 addressing the following questions: 1) With regard to the property at issue in the Coalition Data Requests 4.02 and 4.03, does ATXI agree that the proposed use of the property subject to the Emergency Watershed Protection Program (“EWPP”) Floodplain Easement for construction of the proposed transmission line is inconsistent with the Prohibitions specified in Part III.A. of the EWPP Floodplain Easement? If ATXI’s answer is anything other than an unqualified yes, please explain how ATXI plans to construct a transmission line without (a) digging or destroying vegetative cover in violation of Subpart III.A.2. of the EWPP Floodplain Easement and (b) building structures in the easement area in violation of Subpart III.A.7 of the EWPP Floodplain Easement. 2) With regard to the property subject to the aforementioned EWPP Floodplain Easement referenced in the Coalition Data Requests 4.02 and 4.03, does ATXI contend that it has the ability to acquire an easement that is superior to the EWPP Floodplain Easement or otherwise extinguishes the EWPP Floodplain Easement? If ATXI’s answer is anything other than an unqualified no, please explain the answer in light of the provisions of the EWPP Floodplain Easement itself and 7 C.F.R. §624.10, which is the applicable federal regulation governing floodplain easements acquired by the United States, acting by and through the Natural Resources Conservation Service. Notice is also given by the Administrative Law Judges that any responses and replies to the April 19, 2013 “Motion to Strike MCPO’s Alternate Routes” filed by the Coalition of Property Owners and Interested Parties in Piatt, Douglas, and Moultrie Counties must be received by April 24, 2013 and April 25, 2013, respectively. The April 18, 2013 “Motion to Accept Gan Properties’ Proposed Alternate Route as a Justified Late Filing and Allow Gan Properties to Adopt Additional Alternative Routes Proposed by Moultrie County, Macon County, and Loen Corzine” is denied with the caveat that any party may endorse another’s properly offered route without needing to seek leave to do so. 3. ATXI’s April 17, 2013 “Motion to Strike Portions of Certain Intervenors’ Direct Testimony and For an Expedited Ruling” is granted in part and denied in part. Accordingly, the following testimony and exhibits are stricken: a. Donna Allen, pp. 2:33 (“the Allen family and the Dawson family”); 7:174–85 (“Two families have … Exhibits 3 and 4.”); 9:218–21 (“I have attached … Exhibit 5.”); Exhibit 3, Exhibit 4, and Exhibit 5; b. Stuart Kaiser, p. 3 (the phrase “, and would decimate the people at the dairy farm and along their property”); c. Michael Lockwood, p. 3, second sentence in answer to question 9 (“My neighbors … directly affected.”); and d. Dr. Magdi Ragheb, p. 16:321–333. 4. Revised versions of the written testimony containing language stricken as a result of these rulings should be submitted prior to the evidentiary hearing. For each blank area, an appropriate notation shall be made indicating that the space is intentionally left blank following the striking of the offered testimony. All remaining testimony will be given the appropriate weight. 5. The April 15, 2013 “Motion for Leave to e-Docket Nunc Pro Tunc to March 27, 2013 the Direct Testimony of George Orin on behalf of Rural Clark and Edgar County Concerned Citizens” is granted. Notice is also given by the Administrative Law Judges of the following requirements and procedures that are in place in preparation for the evidentiary hearing and the remainder of this docket: 1. All parties are directed to cooperate and submit to the Administrative Law Judges by 12:00 P.M. May 9, 2013 a joint list of witnesses indicating on which day each witness is expected to testify and the anticipated duration of cross-examination of each witness by each party. In preparation for creating this list, each party shall provide to ATXI by May 6, 2013, the availability of its witnesses during the evidentiary hearing in this matter and its cross-examination time estimates for other parties’ witnesses. 2. When offering testimony and attachments for admission into the record at the evidentiary hearing, each party must be sure to identify with an appropriate exhibit number each piece of testimony and attachment (for example: Staff Exhibit 1.0 with attached Exhibit 1.1). 3. For any witness for whom no party has any questions, parties are reminded to ask the Administrative Law Judges whether they have any questions for such a witness before planning to admit that witness’ testimony via affidavit. 4. When testimony is to be offered in conjunction with an affidavit, if the affidavit is not already part of the witness’ testimony, the affidavit must be identified as an exhibit as well. 5. With regard to any witness that has any non-substantive corrections to their testimony, parties are advised to simply submit an errata rather than file a motion for leave to correct the errors. In the event that any corrections are made to testimony prior to the evidentiary hearing, a corrected version of the testimony must either be (a) filed on e-Docket or (b) brought to the evidentiary hearing. 6. On the first day of the evidentiary hearing, each party must provide a list of the exhibits it intends to offer into the record. If an exhibit was filed on e-Docket, the date on which it was filed and an indication of whether it is a corrected, revised, or confidential exhibit must be provided as well. Cross exhibits that a party may offer at the evidentiary hearing need not be included on the list. The exhibit list need not be filed on e-Docket. To be clear, only the version of the testimony that a party intends to rely upon need be listed. 7. With regard to any confidential designations, parties shall be prepared to explain/justify any such designations. 8. All parties are directed to cooperate and submit to the Administrative Law Judges by May 23, 2013 a joint proposed outline for use in the briefs.
