Service - Administrative Law Judge Ruling
Notice given that the Administrative Law Judge has completed a review of the application filed by Interra ES LLC ("Applicant") on September 13, 2012 and hereby rules that the information described below shall be filed with the Chief Clerk of the Illinois Commerce Commission on or before October 4, 2012. The response to this ruling must include (1) the docket number, case caption, and an original signature, (2) a verification page, and (3) a certificate of service indicating that the response was served on all those on the service list. The response to this ruling must be actually received by the date indicated, regardless of whether the response is filed with the Chief Clerk as hardcopy or electronically through e-Docket. Applicant shall also electronically serve its response on the Administrative Law Judge (jalbers@icc.illinois.gov) by the date indicated. 1) In searching the Illinois Secretary of State’s website to confirm Applicant’s status as being authorized to conduct business in Illinois, Applicant is not found. Nor is Applicant found under the name of “Interra Energy Solutions,” which is referenced in the Rider attached to the application. Please provide evidence of Applicant being in good standing with the Illinois Secretary of State and being authorized to conduct business in Illinois. 2) Paragraph 2 of the application indicates that Applicant was created under the laws of Illinois. The Rider attached to the application, however, references “Interra ES LLC, a Delaware limited liability company.” Please clarify under which State’s laws Applicant was created under. If the Rider needs to be corrected, please do so. 3) Submission of the Rider without a copy of the underlying license or permit bond is insufficient to demonstrate to compliance with the requirements of 83 Ill. Adm. Code 454.80. Please provide a copy of the underlying bond. 4) Section 454.60(c) requires Applicant to include a corporate organizational chart indicating the position of persons used to meet the managerial qualification requirements. The “organizational chart” that Applicant included within Attachment A simply lists three individuals and their job titles. What Applicant provided in this regard does not satisfy Section 454.60(c) in that the reporting hierarchy for Applicant’s listed employees is not shown. To fully comply with Section 454.60(c), Applicant must provide an organizational chart that reflects the reporting hierarchy of the listed individuals. Parties advised electronically.
