Service - Administrative Law Judge Ruling
Notice given that the Administrative Law Judge has completed a review of the application filed by Total Marketing Concepts, Inc. ("Applicant") on August 2, 2012 and hereby rules that the information described below shall be filed with the Chief Clerk of the Illinois Commerce Commission on or before August 13, 2012. The response to this ruling must include (1) the docket number, case caption, and an original signature, (2) a verification page, and (3) a certificate of service indicating that the response was served on all those on the service list. The response to this ruling must be actually received by the date indicated, regardless of whether the response is filed with the Chief Clerk electronically or as hardcopy. Applicant shall also electronically serve its response on the Administrative Law Judge (jalbers@icc.illinois.gov) by the date indicated. Technical Requirements - Section 454.70(a) of Part 454 states that “[an] applicant shall be deemed to possess sufficient technical capabilities to provide agency, brokering or consulting services if the applicant can demonstrate that it has had experience in the electric industry of at least one year.” Section 454.70(b) states that “[the] applicant shall include in its application an exhibit containing occupational background information on the persons who are being used to satisfy the requirements of [Section 454.70].” Applicant’s response to Paragraph 10 of the application indicates that more than one resume is included in Attachment B to the application. Attachment B, however, includes only a brief resume for Andrew Dorko, Jr. Mr. Dorko’s experience does not satisfy the technical experience requirement of Part 454. If Applicant wishes to purse to this matter, please identify at least one individual in Applicant’s employ that has at least one year of experience in the electric industry. To ensure that sufficient detail is provided, please provide the following information for each individual: 1) Applicant should list each company/business in the electric industry that employed the individual and identify the duration of employment by “month/year” to “month/year.” 2) For each company/business in the electric industry that employed the individual, identify the individual’s specific job duties. The response to this ruling must include (1) the docket number, case caption, and an original signature, (2) a verification page, and (3) a certificate of service indicating that the response was served on all those on the service list. The response to this ruling must be actually received by the date indicated, regardless of whether the response is filed with the Chief Clerk electronically or as hardcopy. Applicant shall also electronically serve its response on the Administrative Law Judge (jalbers@icc.illinois.gov) by the date indicated. Technical Requirements - As referenced in the August 7, 2012 ruling, Section 454.70 of Part 454 discusses the technical requirements pertaining to licensure as an electric agent, broker, or consultant in Illinois. The August 7, 2012 ruling also specified the format in which Applicant is to present its information demonstrating compliance with Section 454.70. In its August 14, 2012 response to the ruling, Applicant failed to present the information in the format specified in the ruling. Therefore, while it is apparent that Applicant’s Vice President of Operations, George Lonabough, has significant experience in the area of telecommunications, it is not exactly clear what experience Mr. Lonabough has had in the electric industry. To remedy this ambiguity, please provide the following information relating to Mr. Lonabough: 1) Applicant should list each company/business in the electric industry that employed the individual and identify the duration of employment by “month/year” to “month/year.” 2) For each company/business in the electric industry that employed the individual, identify the individual’s specific job duties.
