The general scope of this proceeding is clearly within the authority of the Commission. At a minimum, the Commission has rulemaking authority, pursuant to 220 ILCS 5/8-501, over the utilities and RESs and, pursuant to 220 ILCS 5/16-104(b), over the aggregation of load. Although Staff’s draft rule may not confine itself explicitly to the entities over which the Commission has jurisdiction, dismissing the entire rulemaking is not appropriate. The suggestion by ComEd to hold further workshops may be beneficial and parties should inform the ALJ if those are going to take place. Otherwise, procedurally, the next step is a Proposed First Notice Order that will address this issue and parties will have an opportunity to respond on exceptions. Who keeps the records? For how long? • If some form of Staff’s Draft Rule regarding customer disclosures is adopted, would Aggregation Suppliers perform the opt-in or opt-out on behalf of Governmental Aggregators? Who keeps the records? For how long? Who determines whether there has been compliance? • Do Aggregation Suppliers currently perform the opt-in or opt-out process on behalf of Governmental Aggregators? Is this a uniform procedure? Give examples of governmental units for whom Aggregation Suppliers are performing this job. • How would a violation of the customer disclosure requirements be determined? Could a customer file a complaint at the ICC against an Aggregation Supplier alleging that they were improperly switched because they did not receive notice of the opt-out? Could the ICC initiate an investigation of an Aggregation Supplier for failing to notify customers? How would penalties be determined and assessed? • Do Aggregation Suppliers currently send Part 412.110 Uniform Disclosure Statements after acquiring customers through a municipal aggregation?
