    Notice given that the Administrative Law Judge has completed a review of Trebel, LLC’s ("Applicant") July 19, 2012 response to the July 11, 2012 Administrative Law Judge ruling and hereby rules that the information described below shall be filed with the Chief Clerk of the Illinois Commerce Commission on or before July 27, 2012. The response to this ruling must include (1) the docket number, case caption, and an original signature, (2) a verification page, and (3) a certificate of service indicating that the response was served on all those on the service list. The response to this ruling must be actually received by the date indicated, regardless of whether the response is filed with the Chief Clerk electronically or as hardcopy. Applicant shall also electronically serve its response on the Administrative Law Judge (jalbers@icc.illinois.gov) by the date indicated.
    Technical Requirements -
    Section 454.70(a) of Part 454 states that “[an] applicant shall be deemed to possess sufficient technical capabilities to provide agency, brokering or consulting services if the applicant can demonstrate that it has had experience in the electric industry of at least one year.” Section 454.70(b) states that “[the] applicant shall include in its application an exhibit containing occupational background information on the persons who are being used to satisfy the requirements of [Section 454.70].” In its July 19, 2012 response to the Administrative Law Judge ruling, Applicant indicates that Mr. Belcastro “served as a commercial lender to one of Ohio’s energy marketers serving both electric and natural gas.” Whether Mr. Belcastro worked for a bank or the unspecified Ohio energy marketer is not clear; nor is the exact nature of his experience clear. 1) Please specify who Mr. Belcastro’s employer was during the referenced two-year period.
    2) If Mr. Belcastro was not employed by the Ohio energy marketer, please describe the nature of his relationship with the energy marketer. 3) Please identify the duration of the referenced employment by “month/year” to “month/year” and identify Mr. Belcastro’s specific job duties. 4) Applicant indicates that Mr. Belcastro “assisted in securing two municipal aggregations” during the referenced two-year period. Please describe the nature and the capacity in which he provided that assistance.
    5) Please explain how Mr. Belcastro’s experience as a “commercial lender” constitutes experience in the electric industry.
    6) Please clarify whether Applicant is relying on Mr. Belcastro’s experience “as a commercial lender to one of Ohio’s energy marketers” or his experience as owner of Applicant to satisfy the requirements of 83 Ill. Adm. Code 454.70. Notice served electronically to parties.

    General Requirements - 1) Paragraph 7 of the application form directs an applicant to identify other jurisdictions where it possesses similar authority to provide agent, broker, or consultant services. Applicant’s response to Paragraph 7 indicates that it has applications pending in several states. Applicant also indicates that it has been operating in states that do not require licensing. Please specifically identify those states where Applicant provides any kind of agent, broker, or consultant services, regardless of whether licensure is required. Please also identify those states in which Applicant has an application pending. In those states where Applicant provides such services or has an application to do so pending, please indicate whether Applicant provides electric or natural gas services, or both. 2) Paragraph 8 of the application form pertains to various certifications to be made by an applicant. Applicant includes the note “See attached” at Paragraph 8 of its application, but none of Applicant’s attachments reference Paragraph 8. Please address the requirements of Paragraph 8.
    Managerial Requirements -
    3) Section 454.60(a) and (b) of 83 Ill. Adm. Code 454, “Licensure of Retail Electric Agents, Brokers, and Consultants,” (“Part 454”), requires Applicant to demonstrate that it has had at least one year of management experience with a business enterprise and to provide occupational background information for the person(s) with that experience. Applicant’s attachment to the application contains very brief background information on an individual that Applicant intends to use to satisfy the requirements of Section 454.60. The provided information does not include enough details on the individual’s managerial experience. Please provide the following information:
    a) Applicant should list each company/business which employed the individual, and identify the duration of employment by “month/year” to “month/year.” b) For each company/business that employed the individual, identify the individual’s specific job duties. 4) Section 454.60(c) of Part 454, states, “[the] applicant shall include in its application an exhibit containing a corporate organizational chart and indicating the position of persons indicated in subsection (a) of [Section 454.60].” Applicant did not provide the required organizational chart. Please provide the required corporate organization chart in compliance with Section 454.60(c).
