    Notice is hereby given that the Chief Administrative Law Judge has completed a preliminary review of the application for an alternative retail electric supplier ("ARES") certificate filed by Palmco Power IL, LLC, (“Applicant”) in Docket No. 12-0269, and hereby rules that the following information described below, shall be filed with the Illinois Commerce Commission ("Commission"). If filed electronically via the Commission's e-docket system, this verified response shall be filed with the Chief Clerk of the Commission on or before April 27, 2012. If the filing is made by non-electronic means, then April 27, 2012 is a mailing date. Applicant shall also serve a copy of its response on the Chief Administrative Law Judge (mwallace@icc.illinois.gov). For purposes of doing so, April 27, 2012 is a receipt or “in hand” date, not later than 5:00 P.M., by electronic mail, Fax (217-524-8928) or otherwise. General - • Subsection 451.30(a) requires Applicant to publish notice of its application in the Official State Newspaper within 10 days following application filing, and to file proof of that publication with the Clerk of the Commission within 5 days after publication. The application filing date is April 5. Though at the time of Staff’s review the proof of publication was not yet filed with the Clerk of the Commission. • Subsection 451.30(c)(3) requires that proof of notification of an intent to serve in any utility’s service area has been previously provided to the utility, and paragraph 9 of the application states that Applicant seeks authorization in the entire state. Though Applicant claims in paragraph 11 that Attachment B provides the required proof of notification, Attachment B includes letters sent to only two utilities: Commonwealth Edison Company (ComEd) and Ameren Illinois Company (AIC). Therefore, Applicant must either revise paragraph 9 of the application to state that Applicant only seeks authority in the service areas of ComEd and AIC, or Applicant must amend Attachment B so that it includes proof that Applicant notified all the utilities in the state. • The Applicant is directed to disclose whether it has had any complaints filed against it for its provision of any services in the electric or gas industry in this or any other jurisdiction. If yes, the Applicant is directed to include in its response the nature of the complaint, the jurisdiction, and the ultimate resolution. Notice served electronically to parties.
