Service - Administrative Law Judge Ruling
Notice given that the Administrative Law Judge has completed a preliminary review of the application for an alternative gas supplier ("AGS") certificate filed by HIKO Energy, LLC (“Applicant”) in Docket No. 12-0262, and hereby rules that the information described below shall be filed with the Chief Clerk of the Illinois Commerce Commission ("Commission") on or before April 20, 2012. The response to this ruling shall be verified and must be actually received by the date indicated, regardless of whether the response is filed with the Chief Clerk electronically or as hardcopy. Applicant shall also electronically serve a Word version of its response on the Administrative Law Judge (syoder@icc.illinois.gov ) by the date indicated. Miscellaneous Requirements - 1. The Applicant is directed to disclose whether it is licensed as an alternative gas supplier in any other jurisdictions, similar to the licensure required under Section 19-110 of the Illinois Public Utilities Act (the "Act"). 2. The Applicant is directed to disclose whether it has had any complaints filed against it for its provision of any services in the electric or gas industry in this or any other jurisdiction. If yes, the Applicant is directed to include in its response the nature of the complaint, the jurisdiction, and the ultimate resolution. General Requirements - 1. Applicant is directed to state whether it has been denied a natural gas supplier license in any state in the United States pursuant to Section 19-110(d) of the Act. 2. Applicant is directed to state whether it has had a natural gas supplier license suspended or revoked by any state in the United States pursuant to Section 19-110 (d) of the Act. 3. Applicant is directed to state where, if any, it has other natural gas supplier license applications pending in the United States pursuant to Section 19-110(d) of the Act. 4. Applicant is directed to state whether it is the subject of any lawsuits filed in a court of law or formal complaints filed with a regulatory agency alleging fraud, deception or unfair marketing practices, or other similar allegations, identifying the name, case number, and jurisdiction of each such lawsuit or complaint, pursuant to Section 19-110(d) of the Act. 5. Applicant is directed to certify its commitment of resources to the management of sales and marketing staff, through affirmative managerial policies, independent audits, technology, hands on field monitoring and training, and, in the case of any sales personnel or sales agents, within the State of Illinois, the applicant’s managerial presence within the State, pursuant to Section19-110(e)(1)(C) of the Act. 6. Pursuant to Part 551.30(a) of the Illinois Administrative Code, the Applicant shall publish notice of its application in the Official State Newspaper with 10 days following the filing of the application. The Applicant shall file proof of publication with the Clerk of the Commission. The Applicant filed a Proof of Publication with a publication date of February 10, 2012, which is approximately two months prior to the filing date of the application. The Applicant is directed to re-publish the notice of its application, and file proof of the publication with the Clerk of the Commission. Technical Licensing Requirements - 1. Part 551.90(b) requires the applicant to show that it has individuals on staff with four years natural gas sales experience and two years experience working with the rules and practices established by the North American Energy Standards Board. The Applicant listed three individuals that it claimed met these requirements. While it does appear that these individuals have the necessary four years of natural gas sales experience, it is unclear from the information provided whether they have the necessary two years experience working with the rules and practices established by the North American Energy Standards Board. The Applicant is directed to provide additional information which makes it clear who on its staff has this experience. 2. Additionally, all three individuals that the Applicant is offering for this requirement are consultants on retainer according to Attachment 5. It is unclear from the Application how long these individuals will be retained as consultants, and whether the Applicant can continue to meet these requirements if and when the individuals leave. Therefore, either 1) the Applicant must provide a copy of the consulting contracts for these three individuals that shows the terms and duration of service, or 2) the Applicant must provide background information for additional in-house employees that can meet the criteria of this Part.
