  Notice given by the Administrative Law Judge that 220 ILCS 5/16-128A(d)(12) of the Public Utilities Act (“Act”) provides in part the following: Rules regulating the installation, maintenance, or repair of electric vehicle charging stations, in which the Commission may establish separate requirements based upon the characteristics of electric vehicle charging stations, so long as it is in accordance with the requirements of subsection (a) of Section 16-128 and Section 16-128A of this Act, shall: (12) ensure that all persons or entities that install, maintain, or repair electric vehicle charging stations obtain certificates of insurance in sufficient amounts and coverages that the Commission so determines and, if necessary as determined by the Commission, names the affected public utility as an additional insured; and … The first notice rule for 83 Ill. Adm. Code 469 published in the Illinois Register on November 26, 2012 does not appear to address this provision of the Act. So as to ensure compliance with the Act, Commission Staff is directed to offer language for the rule addressing Section 16-128A(d)(12). Other parties are strongly encouraged to offer language as well. Responses to this ruling shall be filed with the Chief Clerk no later than March 1, 2013. Replies thereto shall be filed no later than March 8, 2013. Notice is also given that a Word version of any responses and replies must be served on the Administrative Law Judge at jalbers@icc.illinois.gov. Parties advised electronically.
