Service - Administrative Law Judge Ruling
Notice given that the Administrative Law Judge has completed a preliminary review of the application for an alternative gas supplier ("AGS") certificate filed by Champion Energy, LLC (“Applicant”) in Docket No. 12-0120, and hereby rules that the information described below shall be filed with the Chief Clerk of the Illinois Commerce Commission ("Commission") on or before March 1, 2012. The response to this ruling shall be verified and must be actually received by the date indicated, regardless of whether the response is filed with the Chief Clerk electronically or as hardcopy. Applicant shall also electronically serve a Word version of its response on the Administrative Law Judge (syoder@icc.illinois.gov ) by the date indicated. General Requirements 1. 83 III. Adm. Code 551.30(a) indicates that Applicant shall file proof that it published notice of its application in the Official State Newspaper. Applicant needs to demonstrate that it meets this requirement. 2. 83 Illinois Administrative Code 551(c) and 551(c)(2) require an applicant to specify the geographic areas in which it seeks certification and to provide a description of the characteristics of the customer groups it proposes to serve. While the Applicant acknowledges that it only initially would provide service in the territories of Northern Illinois Gas Company, d/b/a Nicor Gas Company ("Nicor"), The Peoples Gas Light and Coke Company ("Peoples Gas"), and North Shore Gas Company ("North Shore"), it is seeking certification for the entire state of Illinois. The Commission does not currently posses authority to authorize an AGS to provide service beyond the service areas of Nicor, North Shore and Peoples Gas. Therefore, to avoid the possible requirement that a proposed order must be served in this proceeding, Applicant is directed to indicate if it objects to an order granting a certificate of service authority limited to the service territories of Nicor, North Shore, and Peoples Gas. If Applicant does not object to such an order, Applicant would be free to file an application for an amended certificate of service authority in the event additional service territories become open to competition. Financial Requirements 3. 83 III. Adm. Code 551.80(c)(4)(B) requires that Applicant provide a copy of the borrowing agreement upon which it relies to meet the financial requirements. Applicant failed to provide a copy of the entire borrowing requirement, but rather provided what it considered the pertinent portions. The Applicant is hereby directed to provide a copy of the entire borrowing agreement. Applicant is directed to provide a schedule, with references to each input of the calculation, showing the currently available amount of any borrowing agreements, including all deductions resulting from any covenants or other limitations governing each agreement. Additionally, the applicant is directed to provide an organizational chart to demonstrate the relationship of the entities mentioned in Attachment E, page 2 and any additional affiliated companies to these entities. The Applicant is direct to disclose whether it has had any complaints filed against it for its provision of any services in the electric or gas industry in this or any other jurisdiction. If yes, the Applicant is directed to include in its response the nature of the complaint, the jurisdiction, and the ultimate resolution. Notice served electronically to parties.
