    Notice given that the Administrative Law Judge has completed a preliminary review of the application for an alternative retail electric supplier ("ARES") certificate filed by Smart Energy, LLC (“Applicant”) in Docket No. 12-0105, and hereby rules that the information described below shall be filed with the Chief Clerk of the Illinois Commerce Commission ("Commission") on or before March 7, 2012. The response to this ruling shall be verified and must be actually received by the date indicated, regardless of whether the response is filed with the Chief Clerk electronically or as hardcopy. Applicant shall also electronically serve a Word version of its response on the Administrative Law Judge (syoder@icc.illinois.gov ) by the date indicated. General Requirements 1. 83 III. Adm. Code 451.310(g) states in part that Applicant shall “… certify that it will provide to residential and small commercial retail customers on a semiannual basis information on how to obtain a list of alternative retail electric suppliers that have been found in the last 3 years by the Commission (pursuant to Section 10-108 of the Act) to have failed to provide service in accordance with the terms of their contracts (pursuant to Section 16-117(g)(4)(C) of the Act).” Applicant did not include the required certification with its application is hereby directed to provide the required certification. 2. 83 Illinois Administrative Code 451.340(d)(c) states, in part, “[with] respect to serving residential and small commercial retail customers, an alternative retail electric supplier must maintain sufficient managerial resources and abilities to provide the service for which it has a certificate of authority.” Applicant did not provide a statement certifying that it will maintain sufficient managerial resources and abilities to provide the service for which it has a certificate of authority. Applicant is hereby directed to provide the required certification. Notice served electronically to parties.
