Service - Administrative Law Judge Ruling
Notice given that the Administrative Law Judge has completed a review of the application filed by Live Energy Inc. ("Applicant") on January 23, 2012 and hereby rules that the information described below shall be filed with the Chief Clerk of the Illinois Commerce Commission (“Commission”) on or before February 17, 2012. The response to this ruling must include (1) the docket number, case caption, and an original signature, (2) a verification page, and (3) a certificate of service indicating that the response was served on all those on the service list. The response to this ruling must be actually received by the Chief Clerk by the date indicated, regardless of whether the response is filed with the Chief Clerk electronically or as hardcopy. Applicant shall also electronically serve a Word version of its response on the Administrative Law Judge (jalbers@icc.illinois.gov) by the date indicated. General Requirements Section 454.90 of 83 Ill. Adm. Code 454, “Licensure of Retail Electric Agents, Brokers, and Consultants,” (“Part 454”), sets forth a code of conduct applicable to any person or entity required to be licensed pursuant to Part 454. Amendments to Section 454.90 became effective on November 1, 2011. Applicant appears to rely on the earlier version of Section 454.90. Applicant must commit to comply with the code of conduct set forth in the currently effective Section 454.90 if it wishes to receive the license it requests. Managerial Requirements Section 454.60(c) of Part 454 states, “[the] applicant shall include in its application an exhibit containing a corporate organizational chart and indicating the position of persons indicated in subsection (a) of [Section 454.60].” Applicant did not provide the required organizational chart. Please provide the required corporate organization chart in compliance with Section 454.60(c). Technical Requirements Section 454.70(a) of Part 454 states, “[an] applicant shall be deemed to possess sufficient technical capabilities to provide agency, brokering or consulting services if the applicant can demonstrate that it has had experience in the electric industry of at least one year.” Applicant attached to its application an exhibit containing background information on Saint Clair Newbern IV and Paul Fershtand. Although the exhibit indicates that both individuals received “Certified Electricity Professional” credentials from the Texas Electricity Professionals Association, such certification is not recognized by the Commission and it is not clear from the remaining information whether either gentleman has had experience in the electric industry of at least one year. Please provide information clearly demonstrating that an employee of Applicant has at least one year of experience in the electric industry in compliance with Section 454.70. Financial Requirements Section 454.80 of Part 454 requires an applicant to execute and maintain a license or permit bond. To satisfy this requirement, Applicant has attached to its application a “Continuation Certificate.” Whether the “Continuation Certificate” satisfies the Illinois requirements is not clear. To remove any doubt, Applicant should provide a license or permit bond using the form available on the Commission’s website. Parties advised electronically.
