    Notice given that the Administrative Law Judge has completed a review of the application filed by Vision IT Energy d/b/a Vision IT Web, Inc. ("Applicant") on December 23, 2011 and hereby rules that the information described below shall be filed with the Chief Clerk of the Illinois Commerce Commission on or before January 20, 2012. The response to this ruling must include (1) the docket number, case caption, and an original signature, (2) a verification page, and (3) a certificate of service indicating that the response was served on all those on the service list. The response to this ruling must be actually received by the date indicated, regardless of whether the response is filed with the Chief Clerk electronically or as hardcopy. Applicant shall also electronically serve a Word version of its response on the Administrative Law Judge (jalbers@icc.illinois.gov) by the date indicated. General Requirements - An applicant must be authorized to transact business in the State of Illinois, which includes possessing a certificate in good standing from the Illinois Secretary of State. Although apparently registered with the Illinois Department of Revenue, Applicant does not possess a certificate in good standing from the Secretary of State. Applicant must remedy this omission before the Commission can grant the requested relief. Paragraph 7 of the application form directs an applicant to identify other jurisdictions where it possesses similar authority to provide ABC services. Paragraph 7 also directs an applicant to disclose whether it has had any complaints filed against it for its provision of any services in the electric or gas industry in this or any other jurisdiction. Applicant’s response to Paragraph 7 indicates that Applicant is not licensed as an ABC in any other jurisdiction, but does not expressly address whether Applicant has had complaints filed against it for its provision of any services in the electric or gas industry. Please identify any such complaints filed against Applicant and include the nature of the complaint, the jurisdiction, and the ultimate resolution.
    Technical Requirements - 83 Ill. Adm. Code 454.70(a) and (b) require Applicant to demonstrate it has experience in the electric industry of at least one year and to provide occupational background information for the person(s) with that experience. In response to this requirement, Applicant references the resumes for Avi Azoulay and Harold Meerbaum attached to the application. Neither resume, however, clearly reflects experience in the electric industry of at least one year. Please provide additional information on one or more individuals within Applicant that clearly indicates that the individual(s) has at least one year of experience in the electric industry and provide occupational background information for the person(s) with that experience. Financial Requirements
    - Applicant’s License or Permit Bond references alternative retail electric suppliers rather than agents, brokers, and consultants. Please revise the License or Permit Bond as follows:
    (1) With regard to conditions on the obligation, the filed bond provides: THE CONDITIONS OF THIS OBLIGATION ARE SUCH, that WHEREAS, the Principal has been or is about to be granted a license or permit to do business to operate as an ARES (Alternative Retail Electric Supplier) under 220 ILCS 5/16-115 and is required to execute this bond under 83 Illinois Administrative Code Part 451.50 by the Obligee.
    The bond should be revised in this regard to read: THE CONDITION OF THE ABOVE OBLIGATION IS SUCH, that whereas, the Principal has been or is about to be granted a license or permit to do business to operate as an ABC (Agent, Broker, or Consultant) under 220 ILCS 5/16-115C and is required to execute this bond under Section 454.80 of 83 Illinois Administrative Code 454 by the Obligee. (2) The paragraph beginning “NOW, Therefore,” references “ARES.” This reference should be to “ABC.”
