Service - Administrative Law Judge Ruling
Notice given that the Administrative Law Judge has completed a review of the application filed by SourceOne, Inc. (DE) ("Applicant") on November 3, 2011 and hereby rules that the information described below shall be filed with the Chief Clerk of the Illinois Commerce Commission on or before December 5, 2011. The response to this ruling must be accompanied by (1) a cover letter identifying the docket number and case caption and containing an original signature, (2) a verification page, and (3) a certificate of service indicating that the response was served on all those on the service list. The response to this ruling must be actually received by the date indicated, regardless of whether the response is filed with the Chief Clerk electronically or as hardcopy. Applicant shall also electronically serve a Word version of its response on the Administrative Law Judge (jalbers@icc.illinois.gov) by the date indicated. Managerial Requirements 83 Ill. Adm. Code 454.60(a) and (b) require Applicant to demonstrate that it has had at least one year of management experience with a business enterprise and to provide occupational background information for the person(s) with that experience. Section 454.60(c) requires Applicant to include a corporate organizational chart indicating the position of the person(s) who Applicant is using to satisfy the managerial requirements. Attachment 5 includes occupational background information for three individuals, but does not identify the duration of the various positions held by those individuals. Since no dates or timeframes are included, Attachment 5 does not demonstrate that any of the three has held a management position for at least one year. Of the three individuals identified in Attachment 5, only Brant Davis is also included on the organizational chart that Applicant provided in response to Section 454.60(c). Applicant should include the duration of the positions held by any individual being offered to demonstrate compliance with Section 454.60(a) and (b). Then, if relying on someone other than Mr. Davis to satisfy Section 454.60(a), Applicant must add the individual’s name and position to the organizational chart that Applicant submits in response to Subsection 454.60(c). Technical Requirements 83 Ill. Adm. Code 454.70(a) and (b) require Applicant to demonstrate it has experience in the electric industry of at least one year and to provide occupational background information for the person(s) with that experience. Attachment 6 includes occupational background information for two individuals, but does not identify the duration of any of the various positions held by those individuals. Specifically, Attachment 6 does not demonstrate that either Matthew Hooks or Jesse Wooster has experience in the electric industry of at least one year. Applicant should include the duration of the positions held by Mr. Hooks and/or Mr. Wooster in order to demonstrate that Applicant meets the technical requirements of Section 454.70. Financial Requirements Please provide a new License or Permit Bond or a rider to the originally submitted bond correcting the error concerning the identity of the Principal. The filed bond identifies the principal as “SouceOne, Inc., 132 Canal Street, Boston, Massachusetts 02114.” The principal should simply be identified as “SourceOne, Inc. (DE).” Parties advised electronically.
