  Notice given that the Administrative Law Judge has completed a review of the application filed by Trinity Energy Services, LLC ("Applicant") on October 31, 2011 and hereby rules that the information described below shall be filed with the Chief Clerk of the Illinois Commerce Commission on or before December 2, 2011. The response to this ruling must be accompanied by (1) a cover letter identifying the docket number and case caption and containing an original signature, (2) a verification page, and (3) a certificate of service indicating that the response was served on all those on the service list. The response to this ruling must be actually received by the date indicated, regardless of whether the response is filed with the Chief Clerk electronically or as hardcopy. Applicant shall also electronically serve a Word version of its response on the Administrative Law Judge (jalbers@icc.illinois.gov) by the date indicated. Managerial Requirements - 83 Ill. Adm. Code 454.60(a) and (b) require Applicant to demonstrate that it has had at least one year of management experience with a business enterprise and to provide occupational background information for the person(s) with that experience. Section 454.60(c) requires Applicant to include a corporate organizational chart indicating the position of the person(s) who Applicant is using to satisfy the managerial requirements. Although Paragraph 9 of the application indicates that Attachment A demonstrates that Applicant meets the managerial requirements of Section 454.60, Attachment A does not include the duration (from month/year to month/year) for any of the occupational experiences listed. Nor does Attachment A include an organizational chart. Please provide additional information on one or more individuals within Applicant that clearly indicates that the individual(s) has at least one year of management experience with a business enterprise and provide occupational background information for the person(s) with that experience. Please also provide the required corporate organizational chart identifying the individual(s) being used to satisfy Section 454.60. Technical Requirements - 83 Ill. Adm. Code 454.70(a) and (b) require Applicant to demonstrate it has experience in the electric industry of at least one year and to provide occupational background information for the person(s) with that experience. Although Paragraph 10 of the application claims that Attachment A and Attachment B demonstrate that Applicant meets the technical requirements of Section 454.70, Attachment A does not identify the duration (from month/year to month/year) for any of the occupational experiences listed, and an Attachment B does not appear to have been filed with the application. Please provide additional information on one or more individuals within Applicant that clearly indicates that the individual(s) has at least one year of experience in the electric industry and provide occupational background information for the person(s) with that experience. Financial Requirements - Please revise the License or Permit Bond as follows: (1) The filed bond identifies the principal as “Trinity Energy Services, LLC, 171 Fairview Avenue, Elmhurst, IL 60126-2759.” The principal should simply be identified as “Trinity Energy Services, LLC.” (2) The filed bond identifies the obligee as “The People of the State of Illinois, 527 E. Capitol Avenue, Springfield, IL 62701.” The obligee should simply be “The People of the State of Illinois.” (3) With regard to conditions on the obligation, the filed bond provides: THE CONDITION OF THIS OBLIGATION IS SUCH, that whereas, the Principal has been or is about to be granted a license or permit to do business as ENERGY CONSULTING/BROKERING COMPANY. The bond should be revised in this regard to read: THE CONDITION OF THE ABOVE OBLIGATION IS SUCH, That whereas, the Principal has been or is about to be granted a license or permit to do business to operate as an ABC (Agent, Broker, or Consultant) under 220 ILCS 5/16-115C and is required to execute this bond under Section 454.80 of 83 Illinois Administrative Code 454 by the Obligee. Please provide a new License or Permit Bond or a rider to the originally submitted bond correcting the errors. Notice served electronically to parties.
