Service - Administrative Law Judge Ruling
Notice given that the Administrative Law Judge has completed a preliminary review of the application for an alternative retail electric supplier ("ARES") certificate filed by Smart Energy, LLC (“Applicant”) in Docket No. 11-0539, and hereby rules that the information described below shall be filed with the Chief Clerk of the Illinois Commerce Commission ("Commission") on or before August 17, 2011. The response to this ruling shall be verified and must be actually received by the date indicated, regardless of whether the response is filed with the Chief Clerk electronically or as hardcopy. Applicant shall also electronically serve a Word version of its response on the Administrative Law Judge (jalbers@icc.illinois.gov) by the date indicated. General Requirements 1. 83 III. Adm. Code 451.30(c)(1) indicates that Applicant shall provide a description of its business. In paragraph 8 of its application, Applicant provided a description of its proposed future business but did not provide a description of any current business activities. To the extent that Applicant has engaged in any business activities unrelated to this pending ARES application, Applicant must provide a description of its current business to ensure that there is no conflict between its current business and its proposed future business as an ARES. Technical Requirements 2. 83 III. Adm. Code 451.230(b) indicates that Applicant shall be deemed to possess sufficient technical capabilities to serve retail customers identified in Subpart C if it has at least one individual on its Staff with two years experience buying and selling power and energy in wholesale markets and six months of scheduling experience working for an entity that is either a member of PJM, a market participant in the Midwest ISO, or has a system operator certificate from NERC, or has earned Certified Energy Procurement Professional status by the Association of Energy Engineers or equivalent certification. In addition, 83 III. Adm. Code 451.230(d) indicates that Applicant shall include in its application an exhibit that identifies, by name and job title, the persons on its staff, and agents or contractors utilized pursuant to Section 451.250, with the technical experience required under this Subpart C. The exhibit shall provide a description of the relevant occupational experience for each person, including a description of the duties and the duration of the duties being used to meet each experience requirement of Section 451.230. In paragraph 24 of its application, Applicant indicated that Attachments E and G demonstrate that Applicant meets the technical qualification requirements of Section 451.230. In Attachment E, Applicant indicated that Mr. Nathan Laurell has more than two years experience buying and selling power and energy in wholesale markets. In addition, Applicant indicated that Mr. Phil Gurule of the Energy Services Group has six months of scheduling experience. In Attachment G, Applicant provided an exhibit which identifies by name Mr. Laurell and Mr. Gurule and includes their work experiences. It is not clear from this exhibit whether Mr. Laurell has two years experience buying and selling power in the wholesale markets. It is also not clear whether Mr. Gurule has six months of scheduling experience working for an entity that is either a member of PJM or a market participant in the Midwest ISO. Applicant must amend Attachment G to include the following information to comply with subsections (b) and (d) of Section 451.230: • the name and job title of the persons who will be used to satisfy the required technical experience(s), not their name alone; • the name of the company where Mr. Laurell has had his experience in buying and selling power and energy in wholesale markets, the name of those wholesale markets, a description of Mr. Laurell's experience(s) in buying and selling power and energy in wholesale markets, and the duration of such experience(s) in terms of month(s) and year(s); • the name of the wholesale market(s) where Mr. Gurule has had six months of power scheduling experience, a description of his scheduling experience, and the duration of such experience(s) in terms of month(s) and year(s); and • state clearly whether Energy Services Group or any other company, where Mr. Gurule gained his scheduling experience, is a member of PJM and/or a market participant in the Midwest ISO.
