  Notice given that the Administrative Law Judge has granted the August 8, 2011 "Motion for Leave to File Amended ARES Application" filed by GDF Suez Energy Retail Solutions, LLC (“Applicant”). Notice also given that the Administrative Law Judge has completed a review of Applicant's response to the August 1, 2011 Administrative Law Judge ruling and hereby rules that the information described below shall be filed with the Chief Clerk of the Illinois Commerce Commission ("Commission") on or before August 22, 2011. The response to this ruling shall be verified and must be actually received by the date indicated, regardless of whether the response is filed with the Chief Clerk electronically or as hardcopy. Applicant shall also electronically serve a Word version of its response on the Administrative Law Judge (jalbers@icc.illinois.gov) by the date indicated. Technical Requirements: 1. 83 Ill. Adm. Code 451.330(b) provides that Applicant shall be deemed to possess sufficient technical capabilities to serve retail customers under Subpart D if it has at least one individual on its staff with at least four years experience buying and selling power and energy in wholesale markets AND one of the following: one year of scheduling experience working for an entity that is either a member of PJM or a market participant in the Midwest ISO; or has a system operator certificate from NERC; or has earned Certified Energy Procurement Professional status by the Association of Energy Engineers or equivalent certification. Applicant appears to be relying on Mr. Jay Harpole to fulfill the requirements of Section 451.330(b). From the Amended Attachment 5, it remains unclear if Mr. Harpole personally has the requisite experience or simply oversaw those who engaged in the actual activities which would satisfy Section 451.330(b). Applicant is directed to provide a response to this ruling that specifically matches the experience of Mr. Harpole (or another individual on its staff) with the minimum standards in Section 451.330(b). If Applicant wishes to avail itself of Section 451.330(e), it must explicitly say so and demonstrate the extent its technical resources and abilities match the services that it intends to provide to its customers. Managerial Requirements: 2. 83. Ill. Adm. Code 451.340 requires Applicant to have individuals in management positions who satisfy the following: • three individuals each with four or more years experience with enterprise financial and administration responsibilities including profit and loss responsibilities; and • three individuals each with four years experience buying and selling power and energy in wholesale markets; and • three individuals each with four years electric system operational experience. Rather than identify three individuals each with four years experience buying and selling power and energy in wholesale markets, Amended Attachment 6 identifies only two individuals. Additionally, rather than identify three individuals each with four years electric system operational experience, Amended Attachment 6 appears to reflect that none of its managers meet this requirement. Instead, Applicant appears to be relying on Section 451.340(c) to remedy these shortcomings. Applicant discusses its relationships with its parent GDF Suez Energy Resources NA, Inc. and its affiliate GDF Suez Energy Marketing NA, Inc. Applicant is directed to provide a response to this ruling that specifies whether it is relying on Section 451.340(c) and clarifies the relationship between itself and its parent and the named affiliate. To provide assurances to the Commission, the relationships ought to be contractual and identify the types of "shared services" that Applicant will receive from GDF Suez Energy Resources NA, Inc. and GDF Suez Energy Marketing NA, Inc. Applicant should include a copy of the contract(s) with its response to this ruling identifying the sections therein that pertain to the shared services that will allow Applicant to meet the requirements of Section 451.340. Applicant should identify individuals within GDF Suez Energy Resources NA, Inc. and its affiliate GDF Suez Energy Marketing NA, Inc. that it will use to satisfy Section 451.340 and include background information on those individuals in the same format as Amended Attachment 6. Any such background information, however, should also specifically match the experiences of an individual with the minimum standards of Section 451.340. Notice served electronically to parties.
