Notice given of the following procedural ruling by the Administrative Law Judge regarding the “Motion to Partially Modify Schedule By Agreement, filed by the People of the State of Illinois” (“Motion”). Notice given by the Administrative Law Judge of the following ruling regarding the “Motion to Strike the Testimony of Certain Illinois-American Water Company Witnesses, Certain Exhibits, and to Dismiss the Petition” (“Motion”) filed by the Village of Bolingbrook (“Movant”). The motion to strike is supported by the People of the State of Illinois. The Motion is opposed by Illinois-American Water Company (IAWC). Notice also given by the Administrative Law Judge that it appears that the primary argument in the Motion is that the proposed evidence with which Movant takes issue fails to comply with certain provisions on pages 30 - 31 of the Commission’s Order in Docket 07-0507 (“Order”) where “the Commission directs IAWC to conduct a study comparing the cost of each service obtained from the Service Company to the costs of such services had they been obtained through competitive bidding on the open market.” Notice further given by the Administrative Law Judge that whether or to what extent IAWC’s filing complies with the Order is an open question. In that regard, what constitutes “competitive bidding on the open market”, and whether IAWC’s analysis makes the proper comparisons contemplated in the Order, are not solely legal questions. Nor are they ones where witnesses, including expert witnesses, are in agreement. Under the circumstances, to rule on these underlying questions would be premature. The issues may be argued in the post-hearing briefs. Accordingly the Motion is denied. Parties advised by letter.

Notice given of the following ruling by the Administrative Law Judge pursuant to 83 Ill. Adm. Code 200.875, whereby the Administrative Law Judge hereby issues this post-record data request for certain calculations and numerical analyses: For each water and sewer rate district whose rates would be affected by this proceeding, Illinois American Water Company ("IAWC") is directed to provide a set of schedules showing the rates, by rate classification, that would result if the conclusions in the Proposed Order regarding revenues, operating expenses, rate base, rate of return, cost of service, and rate design were adopted. IAWC is directed to provide a set of schedules, for each water and sewer district, by rate classification, showing a "typical bill" under the conclusions contained in the Proposed Order. For each typical bill schedule, IAWC shall identify, for each rate classification, the typical customer usage assumptions used in the calculations. The percentage change in the typical bill from that applicable under existing rates shall be provided as well. If it wishes, IAWC may also provide additional schedules showing typical bills for customers using relatively low amounts of utility service and relatively high amounts of utility service for each rate district and rate classification. If IAWC provides such additional schedules, it shall identify the assumed usage level in the schedules provided. Other Parties are permitted to provide a response to this ruling containing the calculations and analyses described above. The filing date for all responses to this ruling, and any replies to responses, are March 9, 2010 and March 16, 2010, respectively. All responses and replies thereto shall be verified and filed with the Commission, and copies thereof shall be served on other Parties. Copies of responses and replies shall be served electronically on the Administrative Law Judge by 5:00 P.M. on the date of filing. Parties advised by letter.

Notice given by the Administrative Law Judge of the additional instructions set out by the Illinois Commerce Commission (“Commission”) with respect to Oral Argument for this proceeding that is scheduled for Tuesday, March 23, 2010. They are as follows: (1) The scope of Oral Argument is expanded to include the following additional issues: the implications and effect of recent and proposed Illinois-American Water Company (“IAWC”) rate increases on findings of reasonableness and on ratepayers; rate base, including proposed adjustments to cash-working capital and the business systems plan; proposed adjustments to operating expenses, including affiliated Service Company fees; the effect of inflation; current rate case expenses; including the effect of Section 9-229 of the Public Utilities Act; and recovery of prior rate case expenses; amount and cost of short-term debt in the capital structure; rate design, including the amount of the residential customer charge, the declining usage block for multi-family buildings, and the private fire protection charges in Chicago Metro; advertising practices of IAWC. (2) The order for the presentation of oral arguments, and time allotments, are as follows: IAWC shall be first to present oral argument. IAWC have an allotted time of 20 minutes, which it may divide between initial and rebuttal argument; The Commission Staff will then present oral argument with an allotted time of 15 minutes; The Illinois Attorney General will next present Oral Argument; the allotted time is 15 minutes; Next, the Village of Homer Glen, the City of Champaign, et al. will jointly present oral argument; the allotted time is 15 minutes; The Illinois Industrial Water Consumers will then present Oral Argument; the allotted time is 15 minutes. (3) Irrespective of the issues listed above, the parties should be prepared to answer any questions regarding the record or the pertinent law. Parties advised by letter.
