  Notice given of the following procedural ruling by the Administrative Law Judge in Docket No. 08-0519: On or before November 12, 2008, verifications or affidavits shall be filed (1) by the Illinois Power Agency (“IPA”), verifying the revised plan and the petition seeking approval thereof which were filed October 21, 2008, and (2) by the Ameren Illinois Utilities (“Ameren”), verifying the objections, filed October 27, 2008, to the revised plan. Any responses by the IPA and other Parties to the substantive objections filed October 27, 2008 shall be filed, in verified form, on or before November 12, 2008, and shall be specific to the objections filed by Ameren (1, 2 and 3), Commonwealth Edison Company (I, II, III and IV) and the Illinois Commerce Commission Staff (Section III). Copies shall be served on other parties, and (in Word format) on the Administrative Law Judge, by 5:00 P.M. on the date of filing. Parties advised electronically.

  The Commission in conference determined, pursuant to 220 ILCS 5/16-111.5(d)(3), that a hearing in the above-referenced matter is not necessary; and (2) directed that a procedural order be issued requiring verifications or affidavits to be filed for the revised plan and the petition seeking approval thereof which were filed October 21, 2008, and for the objections to the revised plan which were filed October 27, 2008 to the extent such filings are not already in verified form; and further requiring that all responses to objections, and any other pleadings, be filed in verified form or supported by affidavit.   Notice given of the following procedural ruling by the Administrative Law Judge in Docket No. 08-0519: Section 16-111.5(d)(3) of the Public Utilities Act, 220 ILCS 5/16-111.5, provides, in part, “Within 5 days after the filing of the procurement plan, any person objecting to the procurement plan shall file an objection with the Commission.” Accordingly, any such “objections” shall be filed on or before October 27, 2008. Copies thereof shall be served electronically on other parties, and (in Word format) on the Administrative Law Judge, by 5:00 P.M. on the date of filing. With regard to such objections, please note that incorporation by reference of any comments “submitted to the [Illinois Power] Agency” (“IPA”) pursuant to Section 16-111.5(d)(2) is not acceptable. Pursuant to Section 16-111.5(d)(2), those comments were submitted to the IPA for review by the IPA, not for review by the Illinois Commerce Commission. The instant procedural ruling is concluded.
