  Notice is hereby given by the Administrative Law Judge that Commonwealth Edison Company filed a Petition seeking “Approval of Initial Procurement Plan” in Docket 07-0528, and a “Petition for Approval of Tariffs Implementing a New Competitive Procurement Process and Recovering Procurement Costs” in Docket 07-0531, pursuant to Section 16-111.5 of the Public Utilities Act, 220 ILCS 5/16-111.5. (See Public Act 95-0481) Among other things, Section 16-111.5(j) provides that “within 14 days following filing of an initial procurement plan, any person may file a detailed objection with the Commission contesting the procurement plan…” Thus, the statutory deadline for filing an objection is November 13, 2007. If the Commission determines that a hearing is necessary, a copy of the notice thereof will be posted on the e-Docket system of the Commission’s website. www.icc.illinois.gov/e-docket.   Notice given by the Administrative Law Judge that the due date for any additional filings by the Commission Staff and Intervenors, to further address (1) the objections raised in the filings made by the Staff and Intervenors on November 13, 2007, and (2) the response thereto from Commonwealth Edison Company (“ComEd”) filed November 20, 2007, is November 28, 2007. The due date for any response by ComEd is November 30, 2007. Copies of the Staff and Intervenor filings shall be served electronically on other parties and (in Word format) on the administrative law judge by 12:00 Noon on the date of filing. Copies of the ComEd filing shall be served electronically on other parties and (in Word format) on the Administrative Law Judge by 4:00 P.M. on the date of filing. Notice also given by the Administrative Law Judge that these filings are limited in scope to those objections specifically identified in the November 13 filings, including, among others, hedging during peak periods and related issues. In that regard, the parties are urged to address an issue discussed by the Commission at its November 20, 2007 meeting, that is, the cost of hedging at various levels of the forecasted load versus the likelihood of price volatility and the cost to consumers if that volatility occurs. Any such filings should be presented in the form of empirical analyses regarding this issue in order to aid the Commission in making a fair and reasonable decision. To the extent such empirical analyses were included in previous filings, the parties should provide specific citations to those analyses. Notice further given by the Administrative Law Judge that as indicated in a separate notice to be served, a hearing will be held on December 3, 2007 at 1:30 P.M. Parties will be permitted to participate at the hearing by telephone. No cross examination will occur at this hearing.
