Notice given by the Administrative Law Judge that on January 7, 2004,Commission Staff filed a motion to take administrative notice of the content of the amendments, Staff verified statements regarding the amendments, and Commission orders rendered in Commission docketed proceedings identified in the motion. The only petitioner response, filed January 29, 2004, by Illinois Bell Telephone Company (SBC), concurred with the motion. The motion is granted, in accordance with Title 83 of the Illinois Administrative Code, Section 200.640; and Section 200.10. Notice is also given by the Administrative Law Judge that on January 7, 2003, Commission Staff also moved to waive or cancel conducting an evidentiary hearing in this proceeding. The only petitioner response, filed January 29, 2004, by SBC, concurred with the motion. The information-gathering procedure in this proceeding shall be by taking administrative notice, as ordered above, in place of an evidentiary hearing, in accordance with Section 10- 101of the Public Utilities Act; Title 83 of the Illinois Administrative Code, Sections 763.20, and 200.25. See also 83 Ill. Admin. Code, Sec. 763.340; 763.360; and 200.525. All evidence at issue in this proceeding can be adduced in this matter by taking administrative notice of the proceedings requested in Staff's first motion, and saves the costs to the Commission and the parties of such a hearing. Notice is further given that the above entitled matter was marked “Heard and Taken” by the Administrative Law Judge on February 23, 2004. Parties advised electronically.
