Service - Administrative Law Judge Ruling

Notice is hereby given by the Administrative Law Judge that in its Motion for Entry of a Protective Order, North Shore Gas Company requests entry of a Protective Order prior to providing information to the Complainant. The Complainant has requested that the Company provide a written explanation of the manner in which it calculates a specific charge. The Company has agreed to provide the information as long as the information is not made public.
The Motion is denied because insufficient basis is given for protecting this specific information. At issue in this billing Complaint is whether North Shore has properly calculated the Complainant’s bill when Complainant calls in an actual read when the Company estimates his bill. The manner in which a utility calculates a customer’s bill is not privileged or confidential information and there is no apparent harm to the Company. With respect to the Company’s argument that the information should not be made public because it will dampen its ability to change its policies, this concern can be remedied by a disclaimer that the policy is subject to change.
Thus, North Shore’s Motion for Entry of a Protective Order is denied. North Shore is directed to provide a written response disclosing the information sought by Complainant explaining the Company’s current practice for calculating this charge. North Shore is not required to provide the actual internal document.
At the status hearing scheduled for February 19, 2014, a date for the evidentiary hearing will be selected. Notice mailed to parties.
