    Notice given that the Administrative Law Judge has completed a preliminary review of the application for an alternative gas supplier ("ARES") certificate filed by BFE Scheduling, LLC (“Applicant”) in Docket No. 13-0218, and hereby rules that the information described below shall be filed with the Chief Clerk of the Illinois Commerce Commission ("Commission") on or before April 10, 2013. The response to this ruling shall be verified and must be actually received by the date indicated, regardless of whether the response is filed with the Chief Clerk electronically or as hardcopy. Applicant shall also electronically serve a Word version of its response on the Administrative Law Judge (jvonqual@icc.illinois.gov) by the date indicated. 1. In Attachment C, the applicant submitted a license or permit bond in favor of “State of Illinois”. The applicant is required to execute and maintain a license or permit bond issued by a qualifying surety or insurance company authorized to transact business in the State of Illinois in favor of “the People of the State of Illinois” pursuant to 83 Ill. Adm. Code 451 ("Part 451"), Section 451.50. The applicant shall submit a revised license or permit bond or a rider to the bond that makes the bond in favor of “the People of the State of Illinois." 2. The Applicant provided information to meet financial qualifications pursuant to Section 451.110(a)(2) in four exhibits marked Attachments D – Part 1 through Part 4. The attachments are redacted versions on the Line of Credit mentioned in paragraph 16, page 5 of the Application. a. The Applicant shall provide unredacted versions of the exhibits. b. The Applicant did not request confidential treatment in this proceeding. In order to receive proprietary treatment for these attachments (Attachments D – Part 1 through Part 4), the applicant must file a motion for confidential treatment pursuant to Section 200.430, Protective Orders, of the Commission’s Rules of Practice. c. The Applicant must explain the rationale for the need for confidential treatment and identify the specific portions of the documents for which Applicant is seeking confidential treatment. d. Applicant shall clearly state whether the information for which it seeks confidential treatment is available publicly. e. A public redacted version (with shaded areas showing the space that held removed information) of each document submitted pursuant to Section 200.430 must also be submitted with the proprietary version, i.e., submit a public and confidential version of each exhibit that contains confidential information.
    3. Section 451.110(a)(2)(B) requires that the credits agreements are valid for a period of not less than one year. The term of Applicant's credit agreement is covered in a master agreement that was not included with the application. The Applicant must demonstrate that the line of credit is valid for not less than one year. The application shall include any Master Agreements or other documents that affect the credit agreement used to meet Section 451.110. 4. The Applicant must demonstrate the current amount of the credit agreement showing all limiting covenants. The Applicant shall provide a schedule, with references to each input of the calculation, showing the currently available amount of each line of credit, including all deductions resulting from any covenants or other limitations governing each agreement pursuant to Section 451.110(a)(2)(C)(i). The Applicant must agree to make the same demonstration for its annual continuing compliance reports that use a credit agreement. 5. It is not clearly stated how the three people provided in Attachment F meet the requirements of Section 451.30. The Applicant must clarify what managerial experience the three people provided in Attachment F have to meet the managerial requirements and must provide the dates when the people gained the experience.
    6. Applicant shall provide a corporate organization chart that includes all three people being used to meet the managerial qualifications. 7. The Applicant shall provide a statement indicating whether or not it is certifying that all employees and agents will comply with all relevant parts of Part 451.
