    Notice is hereby given of the following ruling by the Administrative Law Judge regarding the “Motion to Strike Certain Rebuttal Testimony of RGS Witness [James] Crist and ICEA/RESA Witness [Kevin] Wright” (“Motion”) filed by the Citizens Utility Board (“CUB”): The passages of testimony to which CUB objects are identified in the Motion. Responses to the Motion were filed by the Retail Gas Suppliers (“RGS”), and jointly by Illinois Competitive Energy Association (“ICEA”) and the Retail Energy Supply Association (“RESA”). A reply to the responses was filed by CUB. The passages of rebuttal testimony to which CUB objects were filed in response to testimony by CUB witness Martin Cohen. The purpose of Mr. Cohen’s testimony was to respond to Ameren Illinois Company’s “discussion of the possibility of establishing a Small Volume Transportation (‘SVT’) program for natural gas” in its service territory and its request to fund such a program. (CUB Ex. 1.0 at 2)
    CUB objects to the ICEA/RESA and RGS testimony on several grounds, including relevancy.
    Upon reviewing the testimony and the arguments, it is determined that the testimony should not be stricken on relevancy grounds. In his direct testimony, Mr. Cohen appears to rely in part on the lack of consensus at the SVT workshops on the “crucial issue” of consumer protections in support of his recommendation which begins in his next question and answer. (CUB Ex. 1.0 at 4) In the portion of his rebuttal testimony to which CUB objects as irrelevant, ICEA/RESA witness Mr. Wright refers to and describes CUB’s response to ICEA/RESA data request (“DR”) No. 1.02. There, CUB states that the issue of consumer protections was not considered in the workshops and further states that none of the agendas for the workshops included the topic of consumer protections. (ICEA/RESA Ex. 3.0 at 7-8)
    Under the circumstances, the rebuttal testimony of Mr. Wright was reasonably responsive to the expert testimony of Mr. Cohen. With regard to the CUB DR response, it was not unreasonable for Mr. Wright, as an expert witness, to review and rely on the DR response in attempting to construe Mr. Cohen’s testimony and reply to it.
    Similarly, the rebuttal testimony of RGS witness Mr. Crist was reasonably responsive to the expert testimony of Mr. Cohen, and should not be stricken on relevancy grounds.
    CUB’s relevancy objections go to the weight, which may be further argued in the briefs. In its Motion, CUB also objects to statements in the testimony of the ICEA/RESA and RGS witnesses as being inadmissible hearsay. A review of the filings, however, indicates that a portion of the testimony in question consists of, or was based on, observations by the witnesses who authored the testimony. Other testimony subject to the hearsay objection identifies or comments on statements made by CUB in DR responses. That is, CUB was the source of the statements that eventually gave rise to CUB’s hearsay objections. The testimony of the ICEA/RESA and RGS witnesses will not be stricken on hearsay grounds.
    In its Motion, CUB also argues that the agreement of all parties in the workshops was that the exchanges in the workshop process are to be treated confidentially, and that the testimony of ICEA/RESA and RGS witnesses “about the specifics of the exchanges during the workshops is a violation of this confidentiality agreement.” (CUB Motion at Par. 14) As observed in the responses of ICEA/RESA and RGS, however, no such “specifics of the exchanges” were disclosed in the testimony of those witnesses. Accordingly, the testimony will not be stricken on that basis.
    CUB further argues that certain testimony by Mr. Crist is an impermissible legal conclusion. (CUB Motion at Par. 15-17) In its response opposing the Motion, RGS essentially paraphrases Mr. Crist’s testimony to reflect what he meant to observe. While that may be true, argument about what the witness intended to say does not satisfy the objection. The Motion is granted with respect to language on lines 74-76 of Mr. Crist’s rebuttal testimony, beginning with the words “which would not have done so ...” Notice served electronically to parties.
