Service - Administrative Law Judge Ruling
Notice given that the Administrative Law Judge has completed a review of the application filed by Telco Pros, Inc. ("Applicant") on January 14, 2013 and hereby rules that the information described below shall be filed with the Chief Clerk of the Illinois Commerce Commission on or before February 5, 2013. The response to this ruling must include (1) the docket number, case caption, and an original signature, (2) a verification page, and (3) a certificate of service indicating that the response was served on all those on the service list. The response to this ruling must be actually received by the date indicated, regardless of whether the response is filed with the Chief Clerk as hardcopy or electronically through e-Docket. Applicant shall also electronically serve its response on the Administrative Law Judge (jalbers@icc.illinois.gov) by the date indicated. 1) Paragraph 7 of the application form directs an applicant to identify any other states in which it operates as an agent, broker, or consultant. Under paragraph 7, Applicant lists Ohio and Maryland. In the first Appendix A attached to the application, however, Applicant lists other states in which it operates. Please clarify in which states Applicant currently operates as an agent, broker, or consultant in a manner similar to that contemplated under Section 16-115C of the Public Utilities Act. Please also clarify whether Applicant has received any complaints in such states. If any such complaints exist, please include in the response to this ruling the nature of the complaint, the jurisdiction, and the ultimate resolution. 2) Paragraphs 9 and 10 of the application form describe the information that needs to be provided to satisfy the managerial and technical qualifications to operate as an agent, broker, or consultant. Much of the information in the first Appendix A attached to the application appears to be a general description of Applicant’s business and not specific to an individual employed by Applicant. Please provide occupational background information for the person or persons employed by Applicant that clearly satisfies the managerial and technical qualifications set forth in 83 Ill. Adm. Code 454. Please also provide a more descriptive organizational chart reflecting the structure of Applicant. 3) An applicant must execute and maintain a license or permit bond to satisfy the financial qualifications to operate as an agent, broker, or consultant. The second Appendix A attached to the application is a copy of a license bond naming the Pennsylvania Public Utility Commission as obligee. Please provide a license or permit bond relevant to service in Illinois under Section 16-115C of the Public Utilities Act using the “ABC Sample License or Permit Bond” at http://www.icc.illinois.gov/Electricity/ABC.aspx as a template. Notice served electronically to parties.
