Service - Administrative Law Judge Ruling
Notice given that the Administrative Law Judge has completed a review of the application filed by U.S. Power Trade LLC ("Applicant") on January 11, 2013 and hereby rules that the information described below shall be filed with the Chief Clerk of the Illinois Commerce Commission on or before January 31, 2013. The response to this ruling must include (1) the docket number, case caption, and an original signature, (2) a verification page, and (3) a certificate of service indicating that the response was served on all those on the service list. The response to this ruling must be actually received by the date indicated, regardless of whether the response is filed with the Chief Clerk as hardcopy or electronically through e-Docket. Applicant shall also electronically serve its response on the Administrative Law Judge (jalbers@icc.illinois.gov) by the date indicated. Section 454.60(c) of 83 Ill. Adm. Code 454 states, “[the] applicant shall include in its application an exhibit containing a corporate organizational chart and indicating the position of persons indicated in subsection (a) of [Section 454.60].” Applicant did not provide the required organizational chart. Please provide the required organizational chart. Notice served electronically to parties.

Service - Administrative Law Judge Ruling
Notice given that the Administrative Law Judge (“ALJ”) has completed a review of the January 30, 2013 response filed by U.S. Power Trade LLC ("Applicant") to the January 24, 2013 ALJ ruling and hereby rules that the information described below shall be filed with the Chief Clerk of the Illinois Commerce Commission on or before February 5, 2013. The response to this ruling must include (1) the docket number, case caption, and an original signature, (2) a verification page, and (3) a certificate of service indicating that the response was served on all those on the service list. The response to this ruling must be actually received by the date indicated, regardless of whether the response is filed with the Chief Clerk as hardcopy or electronically through e-Docket. Applicant shall also electronically serve its response on the Administrative Law Judge (jalbers@icc.illinois.gov) by the date indicated. Because (1) the application uses the first person plural (eg: “we” and “our”) to describe its business and (2) the documentation from the Illinois Secretary of State attached to the application lists Robert Rizzitano and Geno Jacobson as Applicant’s managers, it is understood that Applicant employs at least two people. The January 24, 2013 ALJ ruling directed Applicant to provide an organizational chart, which should identify Applicant’s structure and at least the position titles within that structure. Rather than provide an organizational chart, however, Applicant simply changed the title on a page in its original application from “ownership chart” to “organizational chart.” The information on the page simply indicates that Robert Rizzitano owns 100% of Applicant. Please provide an actual organizational chart clearly setting forth Applicant’s structure. At a minimum, the position titles within the structure should be included. Because Robert Rizzitano is used to satisfy the managerial and technical qualifications, however, his name must be included under the appropriate position title within the organizational chart. If Applicant no longer employs anyone other than Robert Rizzitano, simply state this in the response to this ruling. Notice served electronically to parties.
