  Notice given that the Administrative Law Judge has completed a preliminary review of the application for an alternative gas supplier ("ARES") certificate filed by Iron Energy LLC (“Applicant”) in Docket No. 12-0672, and hereby rules that the information described below shall be filed with the Chief Clerk of the Illinois Commerce Commission ("Commission") on or before January 4, 2013. The response to this ruling shall be verified and must be actually received by the date indicated, regardless of whether the response is filed with the Chief Clerk electronically or as hardcopy. Applicant shall also electronically serve a Word version of its response on the Administrative Law Judge (jvonqual@icc.illinois.gov) by the date indicated. 1. The Applicant must file verified proof that it published notice of its application in the Official State Newspaper. [451.30(a)] This is not yet a deficiency since the Applicant has 10 days to file, but is included because it has not yet been done; 2. The Applicant is directed to submit a current and complete organizational chart demonstrating its corporate structure (including all affiliated companies); 3. The Applicant shall provide proof that notification of intent to serve in Commonwealth Edison Company's ("ComEd's") service territory has been previously provided to ComEd's service agent; 4. The Applicant shall either clarify in its response or amend its application to remove references to natural gas service in paragraphs 8 and 9; 5. The Applicant shall either clarify in its response or amend its application to delete the inapplicable portion of Paragraph 15; 6. The Applicant should either clarify in its response or amend its application to revise Paragraph 7 to remove inapplicable lnguage; 7. The Applicant shall either clarify in its response or amend Paragraph 19 of its application to reflect that it currently has authority to operate as an ARES in ComEd's service territory; 8. The Applicant shall certify that it will comply with informational and reporting requirements pursuant to Section 16-112 of the Public Utilities Act (220 ILCS 5/1-101 et seq.) (the "Act"); 9. Applicant shall indicate if any formal complaints or lawsuits have been filed against it or its affiliates within three years of filing this Application. If any formal complaints have been filed, Applicant shall provide the jurisdiction, subject matter, and status of the complaint; 10. Applicant shall indicate whether any informal complaints have been filed against it or its affiliates in Illinois. If any such informal complaints have been filed, Applicant shall provide a chart listing, for each month that there were informal complaints in Illinois, the number of Illinois customers, the number of Illinois complaints filed, and a description of the informal complaints. Applicant shall indicate if there are currently any unresolved complaints in Illinois. Notice served electronically to parties.
