    Service - Administrative Law Judge Ruling

    Notice given by the Administrative Law Judges that any response to the December 9, 2013 “Motion of Ameren Transmission Company of Illinois to Strike the Rebuttal Testimony on Rehearing of Dan Long and Julie Miller Instanter” must be received on December 11, 2013. Any replies thereto must be received by December 12, 2013. Notice also given by the Administrative Law Judges of the following requirements and procedures that are in place in preparation for the evidentiary hearing and the remainder of this docket:
    1. All parties are directed to cooperate and submit to the Administrative Law Judges by 12:00 P.M. December 13, 2013 a joint list of witnesses indicating on which day each witness is expected to testify and the anticipated duration of cross-examination of each witness by each party. In preparation for creating this list, each party shall provide to ATXI by December 11, 2013, the availability of its witnesses during the evidentiary hearing in this matter and its cross-examination time estimates for other parties’ witnesses. 2. When offering testimony and attachments for admission into the record at the evidentiary hearing, each party must be sure to identify with an appropriate exhibit number each piece of testimony and attachment (for example: Staff Exhibit 1.0 with attached Exhibit 1.1).
    3. For any witness for whom no party has any questions, parties are reminded to ask the Administrative Law Judges whether they have any questions for such a witness before planning to admit that witness’ testimony via affidavit. 4. When testimony is to be offered in conjunction with an affidavit, if the affidavit is not already part of the witness’ testimony, the affidavit must be identified as an exhibit as well. 5. With regard to any witness that has any non-substantive corrections to their testimony, parties are advised to simply submit an errata rather than file a motion for leave to correct the errors. In the event that any corrections are made to testimony prior to the evidentiary hearing, a corrected version of the testimony must either be (a) filed on e-Docket or (b) brought to the evidentiary hearing. 6. With regard to entering an appearance on each day of the evidentiary hearing, parties are directed to use the attached “appearance form” and provide a hardcopy to the court reporter each morning of the evidentiary hearing.
    7. On the first day of the evidentiary hearing, each party must provide a list of the exhibits it intends to offer into the record. If an exhibit was filed on e-Docket, the date on which it was filed and an indication of whether it is a corrected, revised, or confidential exhibit must be provided as well. Cross exhibits that a party may offer at the evidentiary hearing need not be included on the list. The exhibit list need not be filed on e-Docket. To be clear, only the version of the testimony that a party intends to rely upon need be listed. 8. With regard to any confidential designations, parties shall be prepared to explain/justify any such designations. 9. All parties are directed to cooperate and submit to the Administrative Law Judges by December 23, 2013 a joint proposed outline for use in the briefs. The outline shall reflect issues that have been resolved as well as those that remain contested. If it is not obvious what a particular entry on the outline represents, a note shall be included indicating what is intended. Notice served electronically to parties.

    Notice given by the Administrative Law Judges (“ALJs”) that the November 18, 2013 “Motion for Clarification” filed by Tarble Limestone Enterprises, Coles County Landowners, and the Reed Interests is denied. While sympathetic to the desire to conserve resources, the ALJs are reluctant to limit the Commission’s options as requested in the motion. That being said, the ALJs will clarify that routes within segments of the transmission line for which rehearing was not granted by the Commission will not be considered. Furthermore, for those segments of the transmission line for which rehearing was granted, any combination of routes previously before the Commission may be considered by the Commission on rehearing. Notice served electronically to parties.

    Notice is hereby given that the Administrative Law Judges have denied the April 19, 2013 “Motion to Strike MCPO’s Alternate Routes” filed by the Coalition of Property Owners and Interested Parties in Piatt, Douglas, and Moultrie Counties. Notice is also given that the Administrative Law Judges have granted the May 1, 2013 “Motion to Appear Pro Hac Vice” filed by Ameren Transmission Company of Illinois (“ATCI”). Service - Administrative Law Judge Ruling

    Notice given by the Administrative Law Judges of the following rulings concerning outstanding motions: 1. Ameren Transmission Company of Illinois’ (“ATXI”) April 11, 2013 “Motion to Strike Certain Intervenors’ Untimely Alternate Route Proposals” is granted in part and denied in part. Accordingly, the following testimony and exhibits regarding alternate route proposals are stricken:
    a. Direct Testimony of Kenneth L. Skolnik, on behalf of Gan Properties, LLC: Paragraph 12 beginning at “In furtherance of” through and including Paragraph 14, and Exhibits F-1, F-2, F-3, and G; b. Direct Testimony of George Orin, on behalf of RCECCC: Answer to Question 4, Part A beginning “We believe the path” through and including “the existing right-of-ways” at the end of Part A; c. Direct Testimony of Paula Cooley, on behalf of Macon County Property Owners: Paragraph 7 beginning at “See map of” through and including “to future generations,” and Exhibit C; and d. Direct Testimony of Donna Allen: p. 8, ln. 208 beginning “These existing routes” through and including “Donna Allen Testimony Exhibit 5” on p. 9, ln. 221. 2. The April 18, 2013 “Motion to Accept Gan Properties’ Proposed Alternate Route as a Justified Late Filing and Allow Gan Properties to Adopt Additional Alternative Routes Proposed by Moultrie County, Macon County, and Loen Corzine” is denied with the caveat that any party may endorse another’s properly offered route without needing to seek leave to do so. 3. ATXI’s April 17, 2013 “Motion to Strike Portions of Certain Intervenors’ Direct Testimony and For an Expedited Ruling” is granted in part and denied in part. Accordingly, the following testimony and exhibits are stricken: a. Donna Allen, pp. 2:33 (“the Allen family and the Dawson family”); 7:174–85 (“Two families have … Exhibits 3 and 4.”); 9:218–21 (“I have attached … Exhibit 5.”); Exhibit 3, Exhibit 4, and Exhibit 5;
    b. Stuart Kaiser, p. 3 (the phrase “, and would decimate the people at the dairy farm and along their property”);
    c. Michael Lockwood, p. 3, second sentence in answer to question 9 (“My neighbors … directly affected.”); and
    d. Dr. Magdi Ragheb, p. 16:321–333. 4. Revised versions of the written testimony containing language stricken as a result of these rulings should be submitted prior to the evidentiary hearing. For each blank area, an appropriate notation shall be made indicating that the space is intentionally left blank following the striking of the offered testimony. All remaining testimony will be given the appropriate weight. 5. The April 15, 2013 “Motion for Leave to e-Docket Nunc Pro Tunc to March 27, 2013 the Direct Testimony of George Orin on behalf of Rural Clark and Edgar County Concerned Citizens” is granted.
    Notice is also given by the Administrative Law Judges of the following requirements and procedures that are in place in preparation for the evidentiary hearing and the remainder of this docket:
    1. All parties are directed to cooperate and submit to the Administrative Law Judges by 12:00 P.M. May 9, 2013 a joint list of witnesses indicating on which day each witness is expected to testify and the anticipated duration of cross-examination of each witness by each party. In preparation for creating this list, each party shall provide to ATXI by May 6, 2013, the availability of its witnesses during the evidentiary hearing in this matter and its cross-examination time estimates for other parties’ witnesses.
6. 7. With regard to any confidential designations, parties shall be prepared to explain/justify any such designations. 8. All parties are directed to cooperate and submit to the Administrative Law Judges by May 23, 2013 a joint proposed outline for use in the briefs. The outline shall reflect issues that have been resolved as well as those that remain contested. If it is not obvious what a particular entry on the outline represents, a note shall be included indicating what is intended. Notice served electronically to parties.

    Service - Administrative Law Judge Ruling

    Notice given by the Administrative Law Judges that the April 15, 2013 “Motion to Compel or in the Alternative to Bar Testimony” filed by Stop the Power Lines Coalition (“Coalition”) is denied because STPL Data Requests 4.02 and 4.03 call for legal analysis. Notice is further given by the Administrative Law Judges that because a lack of legal authority to construct a transmission line along the proposed primary route would render the efforts to analyze the suitability of the proposed primary route meaningless, Ameren Transmission Company of Illinois (“ATXI”) is hereby directed to file a legal brief no later than April 23, 2013 addressing the following questions:
    1) With regard to the property at issue in the Coalition Data Requests 4.02 and 4.03, does ATXI agree that the proposed use of the property subject to the Emergency Watershed Protection Program (“EWPP”) Floodplain Easement for construction of the proposed transmission line is inconsistent with the Prohibitions specified in Part III.A. of the EWPP Floodplain Easement? If ATXI’s answer is anything other than an unqualified yes, please explain how ATXI plans to construct a transmission line without (a) digging or destroying vegetative cover in violation of Subpart III.A.2. of the EWPP Floodplain Easement and (b) building structures in the easement area in violation of Subpart III.A.7 of the EWPP Floodplain Easement.
    2) With regard to the property subject to the aforementioned EWPP Floodplain Easement referenced in the Coalition Data Requests 4.02 and 4.03, does ATXI contend that it has the ability to acquire an easement that is superior to the EWPP Floodplain Easement or otherwise extinguishes the EWPP Floodplain Easement? If ATXI’s answer is anything other than an unqualified no, please explain the answer in light of the provisions of the EWPP Floodplain Easement itself and 7 C.F.R. §624.10, which is the applicable federal regulation governing floodplain easements acquired by the United States, acting by and through the Natural Resources Conservation Service. Service - Notice

    Notice given by the Administrative Law Judges that on November 7, 2012, Ameren Transmission Company of Illinois ("ATXI") filed with the Illinois Commerce Commission ("Commission") a petition initiating Docket No. 12-0598. In their petition, ATXI requests the Commission's permission to build a 345-kilovolt electric transmission line from approximately Quincy, Illinois to Terre Haute, Indiana. ATXI proposed a preferred route and an alternative route for their transmission line in their petition. Other parties to this docket, however, have recently proposed alternative routes. You are receiving this notice because the Commission has been informed that you have an interest in property affected by one or more of the recently proposed alternative routes. As a potentially affected property owner, you may participate in this docket, which may ultimately determine the location of the transmission line that ATXI wishes to build. Additional information on this docket may be found on the Commission's e-Docket website. The address for the Commission's e-Docket website is: www.icc.illinois.gov/e-docket/. You will need the docket number of this proceeding (12-0598) to access the relevant information. Notice is also given by the Administrative Law Judges that there is a status hearing scheduled in this proceeding for March 1, 2013 at the offices of the Commission, Springfield, Illinois, Leland Building, 527 East Capitol Avenue at 10:30 A.M. Those who have filed petitions to intervene by March 1, 2013 may participate via telephone with the permission of the Administrative Law Judges.
    Notice is further given by the Administrative Law Judges that due to the length of the list of entities to receive notice of this proceeding, the Chief Clerk’s Office need not include with this notice the list of potentially affected landowners and entities. The list is available electronically on the Commission’s e-Docket system under Docket No. 12-0598. Those unable to access the list electronically may request that the Commission’s Chief Clerk mail a hardcopy to them by calling (217) 782-7434. Be advised that there will be a charge for the mailing of the list. Service - Administrative Law Judge Ruling

    Notice given by the Administrative Law Judges that parties that are corporations, trusts, or other statutorily created entities must be represented by an attorney admitted to practice law in the State of Illinois or eligible to be admitted to practice law in Illinois pro hac vice.
    Notice also given that arguments in support of a particular route in a petition to intervene will not be considered. Such arguments should be made in prepared written testimony submitted in accordance with the schedule issued on January 25, 2013. Notice further given that the January 29, 2013 Second Amended Petition to Intervene of the Colfax-Scott Land Preservation Group is granted. Notice further given that while the Administrative Law Judges are sympathetic to the situation of Staff counsel, the competing scheduling concerns of the various parties under the expedited deadline triggered by Ameren Transmission Company of Illinois’ filing under 220 ILCS 5/8-406.1 compels them to deny Commission Staff’s January 30, 2013 motion to revise the case management plan. Service - Notice

    Notice given by the Administrative Law Judges that on November 7, 2012, Ameren Transmission Company of Illinois ("ATXI") filed with the Illinois Commerce Commission ("Commission") a petition initiating Docket No. 12-0598. In their petition, ATXI requests the Commission's permission to build a 345 kilovolt electric transmission line from approximately Quincy, Illinois to Terre Haute, Indiana. ATXI proposed a preferred route and an alternative route for their transmission line in their petition. Other parties to this docket, however, have recently proposed alternative routes. You are receiving this notice because the Commission has been informed that you have an interest in property affected by one or more of the alternative routes. As a potentially affected property owner, you may participate in this docket, which may ultimately determine the location of the transmission line that ATXI wishes to build. Additional information on this docket may be found on the Commission's e-Docket website. The address for the Commission's e-Docket website is: www.icc.illinois.gov/e-Docket/ You will need the docket number of this proceeding (12-0598) to access the relevant information. Those interested in participating may do so via telephone with the permission of the Administrative Law Judges.
    Notice further given by the Administrative Law Judges that due to the length of the list of entities to receive notice of this proceeding, the Chief Clerk’s Office need not include with this notice the list of potentially affected landowners and entities. The list is available electronically on the Commission’s e-Docket system under Docket No. 12-0598. The web address for the e-Docket system is: http://www.icc.illinois.gov/e-docket/.
