Service - Administrative Law Judge Ruling
Notice given that the Administrative Law Judge has completed a preliminary review of the application filed by Santanna Natural Gas Corporation (d/b/a Santanna Energy Services) (“Applicant”) in Docket No. 12-0407, and hereby rules that a verified response, containing the information and clarifications described below, shall be filed with the Commission. If filed electronically via the Commission's e-docket system, this verified response shall be filed with the Chief Clerk of the Commission on or before July 23, 2012. If the filing is made with the Chief Clerk by non-electronic means, then July 23, 2012 is a mailing date. Applicant shall also serve a copy of its response on the Administrative Law Judge (syoder@icc.illinois.gov). For purposes of doing so, July 23, 2012 is a receipt or “in hand” date, not later than 5:00 P.M., by electronic mail, Fax (217-524-8928) or otherwise. General Licensing Requirements - The Applicant had previously applied for an ARES certificate in Docket No. 12-0217; however the Applicant withdrew the application following a Proposed Order which recommended a denial of the requested certificate. Among the reasons for recommending denial, the Proposed Order contained the following language: “Although Applicant appears to employ experienced personnel and states that it takes all complaints very seriously, due to Applicant's history of customer complaints the Commission is not persuaded that Applicant will adequately observe customers' rights. Applicant's prior declarations of force majeure and bankruptcy also concern the Commission. While these actions were associated with severe weather and market manipulation by others, Applicant's inability to respond to such events without jeopardizing customers calls into question its contingency planning and overall strategy for product pricing. The seriousness of past allegations and Applicant's overall performance in the area of customer service raises serious concerns about the Applicant’s managerial sufficiency that the Commission can not ignore. Accordingly, the Commission will deny the Application, but will do so without prejudice so as to preserve for Applicant an opportunity to renew its request when it can demonstrate stronger performance in serving those customers it is already authorized to serve.” The Applicant is directed to explain what changes, if any, that it has made in its managerial practices to protect customers interests from suffering under similar circumstances, such as severe weather or market manipulation, in the future. The Applicant is directed to indicate what actions it has taken to "demonstrate stronger performance in serving those customers it is already authorized to serve." Notice served electronically to parties.
