Service - Administrative Law Judge Ruling
Notice given that the Administrative Law Judge has completed a preliminary review of the application for an alternative gas supplier ("AGS") certificate filed by Palmco Energy IL, LLC (“Applicant”) in Docket No. 12-0395, and hereby rules that the information described below shall be filed with the Chief Clerk of the Illinois Commerce Commission ("Commission") on or before July 3, 2012. The response to this ruling shall be verified and must be actually received by the date indicated, regardless of whether the response is filed with the Chief Clerk electronically or as hardcopy. Applicant shall also electronically serve a Word version of its response on the Administrative Law Judge (jvonqual@icc.illinois.gov) by the date indicated. Miscellaneous Requirements - The Applicant is directed to disclose whether it has had any complaints filed against it or its affiliates for its provision of any services in the electric or gas industry in this or any other jurisdiction. If yes, the Applicant is directed to include in its response the nature of the complaint, the jurisdiction, and the ultimate resolution. Other Requirements - 1. The Applicant must file proof that it published notice of its application in the Official State Newspaper. [551.30(a)] Applicant is directed to provide documents demonstrating compliance with Section 551.30(a). 2. Part 551.90(b) requires the applicant to show that it has individuals on staff with four years natural gas sales experience and two years experience working with the rules and practices established by the North American Energy Standards Board. The two individuals that are listed as having NAESB experience are external consultants according to Attachment F. It is unclear how long these individuals will be retained as consultants, and whether the Applicant can continue to meet these requirements if and when the individuals leave. Applicant must provide either 1) a copy of the consulting contracts for these three individuals that shows the terms and duration of service, or 2) background information for additional in-house employees that can meet the criteria of this Part. 3. Part 551.100(b) requires the applicant to provide a corporate organizational chart that indicates the position of the persons that meet the criteria for subsection 551.100(a). The Applicant did not provide such a chart. Applicant must provide the missing organizational chart. 4. Section 19-115 of the Act states that "When the dispute is not resolved to the customer's satisfaction, the supplier shall inform the customer of the right to file an informal complaint with the Commission and provide contact information." Attachment C relating to dispute resolution does not include contact information for the Commission. Applicant must provide a revised Attachment C which includes contact information for the Commission pursuant to Section 19-115 (telephone number 800 524-0795, web site www.icc.illinois.gov, and mailing address 527 East Capitol Avenue, Springfield, IL 62701). 5. Section 551.80 requires the applicant to offer to reimburse its Illinois residential and small commercial customers for the additional costs those customers incur to acquire natural gas if the applicant fails to supply such energy as provided in its contract with the customer. This obligation must be covered by an unconditional guarantee or payment bond. Any dollar limitation on the unconditional guarantee or payment bond equal to no less than an estimate of the maximum monthly number of Mcf of natural gas the applicant expects to schedule over the next 12 months times the 12-month average of the "Average City Gate Price, by State" for Illinois, as disclosed for the most recent 12-month period in the Energy Information Administration's (EIA) "Natural Gas Monthly". Applicant must submit each calculation (showing all inputs) including the “Average City Gate Price, by State” data used in each calculation to determine the bond amount for each utility service area. The Applicant shall indicate whether any formal complaints have been filed with any entity or regulatory agency other than Applicant or its affiliates during the previous three calendar years. If the response to this question is affirmative, for each such complaint: Applicant is directed to identify the jurisdiction, nature of such complaint, and ultimate resolution of such complaint.
