Service - Administrative Law Judge Ruling
Notice given that the Administrative Law Judge has completed a review of the application filed by Energy Auction Exchange, LLC ("Applicant") on June 18, 2012 and hereby rules that the information described below shall be filed with the Chief Clerk of the Illinois Commerce Commission on or before July 9, 2012. The response to this ruling must include (1) the docket number, case caption, and an original signature, (2) a verification page, and (3) a certificate of service indicating that the response was served on all those on the service list. The response to this ruling must be actually received by the date indicated, regardless of whether the response is filed with the Chief Clerk electronically or as hardcopy. Applicant shall also electronically serve its response on the Administrative Law Judge (jalbers@icc.illinois.gov) by the date indicated. General Requirements - 1. Section 200.110(b) of 83 Ill. Adm. Code 200 states in part, “All pleadings or other documents shall be composed in either Arial or Times New Roman font, black type on white background. The text of pleadings or documents shall be at least 12-point.” Applicant is advised to ensure compliance with such Commission rules in all future filings. 2. Paragraph 8 of the application form contains subparts (a) through (f). No response is provided to subpart (c) while subpart (d) is completely missing. Please respond fully to subparts (c) and (d) of paragraph 8 of the application form. Technical Requirements - 3. Section 454.70(a) of 83 Ill. Adm. Code 454 (“Part 454”) states that “[an] applicant shall be deemed to possess sufficient technical capabilities to provide agency, brokering or consulting services if the applicant can demonstrate that it has had experience in the electric industry of at least one year.” Section 454.70(b) states that “[the] applicant shall include in its application an exhibit containing occupational background information on the persons who are being used to satisfy the requirements of [Section 454.70].” Applicant included an unnamed attachment that contains background information on two individuals that Applicant intends to use to satisfy the requirements of Section 454.70. The provided information, however, does not include enough details on those two individuals’ experience in the electric industry. Please provide the following information: a. For each individual, Applicant should list each company/business in the electric industry that employed the individual and identify the duration of employment by “month/year” to “month/year.” b. For each individual at each company/business in the electric industry, identify the individual’s specific job duties. Financial Requirements - 4. In light of certain discrepancies in the format of the bond attached to the application (for example, the identification of the obligee and the condition of the obligation), Applicant is directed to resubmit its license or permit bond using the sample ABC license or permit bond form found on the Commission’s web site.
