  Notice given by the Administrative Law Judge of the following ruling on Motion to Reopen Discovery: By agreement of the parties on the record, Intervenor data requests were to be served by August 3, 2012. The “Turner Intervenors” failed to file any timely data requests. On August 20, 2012, the Turner Intervenors served twenty six pages of questions and requests, requiring 200 or more responses, on Enbridge. Three weeks later, on September 11, 2012, the Turner Intervenors filed a Motion to Reopen Discovery (“Motion”) supported by misstatements of the record in the case. The Motion failed to include a copy of the extensive data requests belatedly served on the Petitioner, Enbridge. Despite Movants’ protestations to the contrary, it is clear that Movants’ attorney: 1) agreed to the Data Request deadline; and, 2) failed to seek timely leave to make late filed requests. Moreover, Movants’ attorney offers no reasons for his delay in making requests other than misstatements about the record regarding the setting of the schedule. A review of the requests belatedly served upon the Petitioner, reveals that they are, as Petitioner argues, massive and burdensome. Many of them are also of questionable relevance. However in view of the substantial property interests at issue for the Turner Intervenors and the comparative resources of the parties to this proceeding, some accommodation for the parties represented by Attorney Turner on this issue may not be entirely inappropriate. Consistent with Illinois Supreme Court Rule 213, the Turner Intervenors Motion is allowed in part. The Turner Intervenors may serve a total of 30 data requests including subparts on Enbridge on or before October 9, 2012. Notice served electronically to parties.
