    Notice given that the Administrative Law Judge has completed a review of the application filed by Energy Solutions Group LLC ("Applicant") on April 6, 2012 and hereby rules that the information described below shall be filed with the Chief Clerk of the Illinois Commerce Commission on or before May 1, 2012. The response to this ruling must include (1) the docket number, case caption, and an original signature, (2) a verification page, and (3) a certificate of service indicating that the response was served on all those on the service list. The response to this ruling must be actually received by the date indicated, regardless of whether the response is filed with the Chief Clerk electronically or as hardcopy. Applicant shall also electronically serve a Word version of its response on the Administrative Law Judge (jalbers@icc.illinois.gov) by the date indicated.
    1) Section 454.40(c)(2) of 83 Ill. Adm. Code 454,
    “Licensure of Retail Electric Agents, Brokers, and Consultants” (“Part 454”), requires an applicant to be authorized to conduct business in Illinois, which includes possessing a certificate in good standing from the Illinois Secretary of State. A review of the Illinois Secretary of State’s website (http://www.ilsos.gov/corporatellc/) indicates that Applicant does not possess a certificate in good standing. Applicant must remedy this omission before the Commission can grant the requested relief. 2) Section 454.90 sets forth a code of conduct applicable to any person or entity required to be licensed pursuant to Part 454. Amendments to Section 454.90 became effective on November 1, 2011. Applicant appears to rely on the earlier version of Section 454.90. Applicant must commit to comply with the code of conduct set forth in the currently effective Section 454.90 if it wishes to receive the license it requests. Parties advised electronically.
