    Notice given that the Administrative Law Judge has completed a review of the application filed by Plymouth Rock Energy, LLC ("Applicant") on March 30, 2012 and hereby rules that a response addressing the deficiencies described below shall be filed with the Chief Clerk of the Illinois Commerce Commission on or before April 16, 2012. The response must include (1) the docket number, case caption, and an original signature, (2) a verification page, and (3) a certificate of service indicating that the response was served on all those on the service list. The response must be actually received by the date indicated, regardless of whether the response is filed with the Chief Clerk electronically or as hardcopy. Applicant shall also electronically serve a Word version of its response on the Administrative Law Judge (jalbers@icc.illinois.gov) by the date indicated. General Requirements 1) Subsection 451.30(a) requires Applicant to publish notice of its application in the Official State Newspaper within 10 days following application filing, and to file proof of that publication with the Clerk of the Commission within 5 days after publication. The application filing date is March 30. Proof of publication has not yet been received. Please provide proof of publication. 2) According to the application, Applicant is a retail electricity supplier in New Jersey and New York. No mention is made of natural gas. The list of informal complaints included with Attachment E, however, identifies several informal complaints in New Jersey and New York that appear to be related to natural gas service. Please address this discrepancy. If Applicant does in fact sell natural gas, specify in which jurisdictions it does so. 3) In response to paragraph 20, Applicant states that it has included “complaint resolution procedures” as an addition to Attachment E. No such procedures appear to be included in any of the attachments. Please address this discrepancy. Managerial Requirements 4) Section 451.340 of 83 Ill. Adm. Code 451 explains that an applicant shall be deemed to possess sufficient managerial capabilities to serve retail customers under Subpart D if, in management positions, it has: o Three or more individuals with four or more years experience with enterprise financial and administration responsibilities including profit and loss responsibilities, o Three or more individuals with four years experience buying and selling power and energy in wholesale markets, and o Three or more individuals with four years electric system operational experience. Applicant’s Attachment E provides background information on individuals that Applicant intends to use to satisfy the requirements of Section 451.340. Whether Adam Sokol and David Sokol, however, possess sufficient management experience is not clear. Please provide the following information: a) For each individual that Applicant intends to use to satisfy the requirements of Section 451.340, Applicant should list each company/business, which employed the individual, and identify the duration of employment by “month/year” to “month/year.” b) For each individual that Applicant intends to use to satisfy the requirements of Section 451.340, at each company/business, identify the individual’s specific job duties. 5) Applicant must also clarify whether the past enterprise financial and administration responsibilities of Adam Sokol, Shyam Persaud, and Andy Sookram included profit and loss responsibilities. parties advised by letter.
