    Notice given that the Administrative Law Judge has completed a review of the application filed by RMI Consulting, Inc. ("Applicant") on February 6, 2012 and hereby rules that the information described below shall be filed with the Chief Clerk of the Illinois Commerce Commission on or before February 16, 2012. The response to this ruling must include (1) the docket number, case caption, and an original signature, (2) a verification page, and (3) a certificate of service indicating that the response was served on all those on the service list. The response to this ruling must be actually received by the date indicated, regardless of whether the response is filed with the Chief Clerk electronically or as hardcopy. Applicant shall also electronically serve a Word version of its response on the Administrative Law Judge (jalbers@icc.illinois.gov) by the date indicated. General Requirements In Paragraph 2 of the application, Applicant states that it “does not do business within the state of IL under any alias.” Please indicate whether Applicant conducts business under any other name in any other state. Please identify the name and indicate in which state(s) such name is used. Section 454.90 of 83 Ill. Adm. Code 454, “Licensure of Retail Electric Agents, Brokers, and Consultants,” (“Part 454”), sets forth a code of conduct applicable to any person or entity required to be licensed pursuant to Part 454. Amendments to Section 454.90 became effective on November 1, 2011. Applicant appears to rely on the earlier version of Section 454.90. Applicant must commit to comply with the code of conduct set forth in the currently effective Section 454.90 if it wishes to receive the license it requests. Technical Requirements Section 454.70(a) and (b) requires Applicant to demonstrate it has experience in the electric industry of at least one year and to provide occupational background information for the person(s) with that experience. Paragraph 10 of the application claims that the occupational background information provided in Attachment A demonstrates that Applicant meets the technical qualifications set forth in Section 454.70. The information included in Attachment A, however, does not clearly demonstrate that any of the three individuals described therein has had experience in the electric industry of at least one year. Attachment A indicates that Mr. Mathis has experience at a vertically integrated utility, but the identity of the electric utility and the duration of Mr. Mathis’ experience at that electric utility is not provided in Attachment A. Applicant should supplement Attachment A by clearly identifying electric industry experience of at least one year for at least one of the individuals listed, including the start month/year and the end month/year of that experience.
