    Notice is hereby given that the Administrative Law Judges have denied the December 17, 2012 “Motion to File Amendment to Amended Petition for Authority to Operate a Regional Next Generation 9-1-1 Pilot Project System” filed by the Counties of Southern Illinois (“CSI”). Shortcomings contributing to the denial of the motion include the absence of a final contract between CSI and NG911, Inc. Without the contract, it is not clear how amending the previously amended petition will allow this docket to proceed in a meaningful way. Concerns that must be addressed include identifying which entity, CSI or NG911, Inc., will be responsible for which functions. Other shortcomings in the motion and attachments include the failure to identify specific revisions in the voluminous documents being modified through the motion. Moreover, in discussing the role of the service provider, it would be useful for CSI to identify the services and discuss each in relation to the relevant statute or rule. Notice is also given that Commission Staff and the parties to this proceeding must be prepared to discuss at the February 6, 2013 status hearing how they intend to proceed, given that this matter has been pending for nearly a year with no progress. Based on the description contained in Commission Staff’s January 8, 2013 response to CSI’s motion, it is not clear how the proposal for bifurcation of this proceeding would allow this docket to proceed in a meaningful way.     Notice given that the Administrative Law Judges have completed a preliminary review of the petition filed by Counties of Southern Illinois (“CSI”) on February 3, 2012 and hereby rule that the deficiencies described below must be remedied through a verified amended petition filed with the Chief Clerk of the Illinois Commerce Commission (“Commission”) on or before February 24, 2012. Applicant shall electronically serve a Word version of its verified amended petition and the attachments thereto (when available in Word format) on the Administrative Law Judges (jalbers@icc.illinois.gov and jvonqual@icc.illinois.gov) by the date indicated. (1) Attached to the petition are multiple exhibits, none of which are identified or referenced therein. Please identify in the amended petition all exhibits attached thereto. (2) Please be sure to mark each attachment to the amended petition with an appropriate exhibit number. (3) The petition references a “Petition for Forbearance” as being attached thereto, but no such forbearance petition appears to be included in CSI’s February 3, 2012 filing. To the extent that CSI seeks the Commission to forbear from applying any provision of 83 Ill. Adm. Code 725, “Standards Applicable to 9-1-1 Emergency Systems,” or any other applicable Commission rule, CSI should include such a request in its amended petition. (4) Several of the attachments to the petition are marked as being proprietary and/or confidential without any indication as to what specific information is considered proprietary and/or confidential. Please submit with the amended petition the attachments with only those containing proprietary and/or confidential material marked as such. Specific proprietary and/or confidential material should be clearly identified as such in any attachment so marked. For any such attachments, a redacted public version of the document must accompany the unredacted confidential version of the document. If CSI seeks confidential treatment for any information contained in or attached to the amended petition, the amended petition must contain a request for confidential treatment and include a specific explanation as to why any redacted information must be kept from the public. (5) CSI has submitted as Exhibit 11 the prepared direct testimony of seven witnesses. Please submit with the amended petition the prepared direct testimony of each witness as a separate exhibit; each such separate exhibit should be given its own exhibit number. (6) Please provide in an exhibit to the amended petition the name of each municipality within the counties involved in the proposed regional “Next Generation 9-1-1 Pilot Project” system. (7) Please provide in an exhibit to the amended petition the name and mailing address of each public safety answering point within the counties involved in the proposed regional “Next Generation 9-1-1 Pilot Project” system. (8) Please provide one complete unredacted double-sided (in color where applicable) hardcopy of the amended petition and exhibits (as revised through this ruling) to the Administrative Law Judges.
