    Notice given by the Administrative Law Judges of the instructions set out by the Illinois Commerce Commission (“Commission”) with respect to Oral Argument for Docket No. 12-0001, Ameren Illinois’s electric rate filing under Section 16-108.5 of the Public Utilities Act. Oral Argument is scheduled for Tuesday, September 11, 2012 at 1:30 P.M. in Springfield. Consistent with Section 200.850(b) of the Rules of Practice, Oral Argument will be limited to parties having filed briefs in this Docket.
    In addition to the requirements contained in Section 200.850(c) of the Rules of Practice, the Commission herein sets the following additional guidelines: (1) The scope of Oral Argument is as follows:
    A. The use of average versus year-end rate base in establishing the reconciliation revenue requirement; B. The appropriate rate of interest for reconciliation adjustments; C. The use of an actual versus hypothetical or average capital structure; D. The appropriate ratemaking treatment of accrued vacation pay; E. The appropriate ratemaking treatment of late payment revenues. (2) Oral argument will be structured as follows: Oral argument will first be held on Items A through C above. Ameren will have 15 minutes for its argument, while any other party wishing to argue these issues will have 10 minutes.
    Oral argument will next be held on Items D and E. Each party wishing to argue these issues will have 10 minutes.
    The allotted time includes Commissioner questions and responses from counsel. Parties may reserve time for rebuttal. Unless parties have filed joint briefs in this Docket, parties are prohibited from pooling or sharing their time allotment.
    (3) Irrespective of the issues listed above, the parties should be prepared to answer any question regarding the record or the pertinent law. (4) Parties intending to present Oral Argument must notify Brian Granahan (bgranahan@icc.illinois.gov), ALJ Albers (jalbers@icc.illinois.gov), and ALJ Yoder (syoder@icc.illinois.gov) with a list of attorneys presenting Oral Argument, and on which topics presentations will be made, by 12:00 p.m. on Friday, September 7, 2012.
    (5) Parties presenting arguments shall provide Mr. Granahan and ALJs Albers and Yoder with exhibits, if any, that will be used for Oral Argument by 12:00 P.M. on Friday, September 7, 2012.
    (6) If an attorney is in need of an accommodation for any visual aid, counsel must inform Mr. Granahan and ALJs Albers and Yoder by 12:00 P.M. on Friday, September 7, 2012, as to the specifics of the accommodation needed. Notice served electronically to parties.

    Notice given by the Administrative Law Judges of the following requirements and procedures that are in place in preparation for the evidentiary hearing and the remainder of this docket:
    1) All parties are directed to cooperate and submit to the Administrative Law Judges by 12:00 PM June 18, 2012 a joint list of witnesses indicating on which day each witness is expected to testify and the anticipated duration of cross-examination of each witness by each party.
    2) For any witness for whom no party has any questions, parties are reminded to ask the Administrative Law Judges whether they have any questions for such a witness before planning to admit that witness’ testimony via affidavit. 3) When testimony is to be offered in conjunction with an affidavit, if the affidavit is not already part of the witness’ testimony, the affidavit must be identified as an exhibit as well.
    4) With regard to any witness that has any non-substantive corrections to their testimony, parties are advised to simply submit an errata rather than file a motion for leave to correct the errors. In the event that any corrections are made to testimony prior to the evidentiary hearing, a corrected version of the testimony must either be (a) filed on e-Docket or (b) brought to the evidentiary hearing. 5) On the first day of the evidentiary hearing, each party must provide a list of the exhibits it intends to offer into the record. If an exhibit was filed on e-Docket, the date on which it was filed and an indication of whether it is a corrected, revised, or confidential exhibit must be provided as well. Cross exhibits that a party may offer at the evidentiary hearing need not be included on the list. Each party should be prepared to disseminate copies of its exhibit list to all other parties at the hearing. The exhibit list need not be filed on e-Docket. 6) With regard to any confidential designations, parties shall be prepared to explain/justify any such designations. 7) All parties are directed to cooperate and submit to the Administrative Law Judges by June 29, 2012 a joint proposed outline for use in the briefs. The outline shall reflect issues that have been resolved as well as those that remain contested. If it is not obvious what a particular entry on the outline represents, a note shall be included indicating what is intended. 8) With regard to any witness that has had only a portion of his/her testimony stricken, the remaining testimony shall be resubmitted as a revised document retaining the line numbers associated with the stricken testimony. For each blank area, an appropriate notation shall be made indicating that the space is intentionally left blank following the striking of the offered testimony. Parties advised electronically.
