    Service - Administrative Law Judge Ruling

    Notice given that the Administrative Law Judge has completed a review of the application filed by Rate Droppers, LLC ("Applicant") on December 27, 2011 and hereby rules that the information described below shall be filed with the Chief Clerk of the Illinois Commerce Commission on or before January 20, 2012. The response to this ruling must include (1) the docket number, case caption, and an original signature, (2) a verification page, and (3) a certificate of service indicating that the response was served on all those on the service list. The response to this ruling must be actually received by the date indicated, regardless of whether the response is filed with the Chief Clerk electronically or as hardcopy. Applicant shall also electronically serve a Word version of its response on the Administrative Law Judge (jalbers@icc.illinois.gov) by the date indicated. General Requirements - Section 454.90 of 83 Ill. Adm. Code 454, “Licensure of Retail Electric Agents, Brokers, and Consultants,” (“Part 454”), sets forth a code of conduct applicable to any person or entity required to be licensed pursuant to Part 454. Amendments to Section 454.90 became effective on November 1, 2011. Applicant appears to rely on the earlier version of Section 454.90. Applicant must commit to comply with the code of conduct set forth in the currently effective Section 454.90 if it wishes to receive the license it requests. Managerial Requirements - Section 454.60(a) and (b) requires Applicant to demonstrate that it has had at least one year of management experience with a business enterprise and to provide occupational background information for the person(s) with that experience. Paragraph 9 of the application refers to Attachment A, but Attachment A does not appear to provide the duration of applicable management experience for any of the individuals listed in Attachment A. Applicant should amend Attachment A to provide the duration (from month/year to month/year) of management experience with a business enterprise for at least one of the listed individuals who has had at least one year of such experience. Technical Requirements - Section 454.70(a) and (b) requires Applicant to demonstrate it has experience in the electric industry of at least one year and to provide occupational background information for the person(s) with that experience. Paragraph 10 of the application refers to Attachment A, but Attachment A does not appear to identify any experience specific to the electric industry for any of the listed individuals. Attachment A instead identifies experience in the energy industry, which may or may not include the electric industry. Applicant should amend Attachment A to describe and provide the duration (from month/year to month/year) of experience in the electric industry for at least one of the listed individuals who has had at least one year of such experience. Financial Requirements - In light of certain discrepancies in the format of the bond attached to the application, Applicant is directed to resubmit its license or permit bond using the sample ABC license or permit bond form found on the Commission’s web site.
