    Notice given that this matter comes before the Administrative Law Judges upon motion for reconsideration of a ruling on January 31, 2012, granting a motion to strike the testimony of Scott Hempling, who is a lawyer, because this testimony is legal opinion. The Citizens Utility Board’s (“CUB”) motion for reconsideration is denied, in its entirety, for the following reasons.
    On page three of the motion for reconsideration, CUB argues that the testimony at issue supplies the Commission with “additional policy considerations based on the existing, applicable statutes.” Policy considerations based upon existing statutes are legal arguments. Therefore, even by CUB’s own assertions, Mr. Hempling’s testimony is a legal argument. On pages 3-4 of the motion for reconsideration, CUB asserts that the original motion to strike filed by Commonwealth Edison Company (ComEd) did not argue that all of the stricken portions were legal opinion. CUB correctly points out that in this motion to strike, ComEd contended that some of this testimony should be stricken because, in ComEd’s view, it was irrelevant. We have again reviewed these portions of the testimony at issue and again conclude that they are improper legal arguments made in testimony. Merely because ComEd argued relevancy does not mean that other rules of evidence are not in question.
    We finally note that this ruling does not appear to prejudice CUB. As the ruling of January 31, 2012 asserted, the issue here is form, not substance. CUB is free to argue any assertion made by Mr. Hempling using the proper legal venues available to it, such as, briefs or motions. Parties advised electronically.

    Notice given that this matter comes before the Administrative Law Judges upon motion filed by Commonwealth Edison Company to strike the testimony of Scott Hempling. This motion is granted, in its entirety.
    We note that Mr. Hempling is a lawyer. Generally, Mr. Hempling is testifying, in a very broad sense, as to a perceived tension between the general policy in the Public Utilities Act and the statute giving rise to the instant docket, 220 ILCS 5/16-108.5. Since this Commission’s policies must stem from the Public Utilities Act, as that is the sole source of this Commission’s ability to act, this testimony is what the law is, or what Mr. Hempling feels the law should be. It is well-settled that a witness may not give testimony regarding statutory interpretation. (See, e.g., Northern Moraine Wastewater Reclamation District v. Illinois Commerce Commission, 392 Ill. App. 3d 542, 573, 912 N.E.2d 204 (2nd Dist. 2009). In other words, lawyers can’t just testify regarding the law. However, this ruling is made (at this time) as to the form of the legal arguments raised in Mr. Hempling’s testimony, not the substance of those arguments.     Notice given that this matter comes before the Administrative Law Judges upon a Motion filed by Commonwealth Edison Company ("ComEd") to limit the scope of discovery via a Protective Order. This Motion is denied, with the following caveats to be observed by all of the parties and Staff: 1. No party contends that rate design is within the scope of this docket. (See, .e.g, BOMA/Chicago's Response to this Motion, at par. 3, "While BOMA/Chicago understands that alternative rate designs are outside the purview of the proceeding. . . ." 2. While we do not define here the scope of the proceeding at bar, we do note that, in addition to the statutory provisions cited by ComEd, a conclusion that alternative rate designs are not the subject of this docket, but, are the subject of another subsequent docket, is consistent with due process, as otherwise, the General Assembly would have intended to litigate many, many topics in a very short period of time, which would have severely limited the parties' and Staff's ability to litigate these issues in a manner that may be inconsistent with the ability of those parties, and Staff, to obtain information on discovery in a manner that conforms with due process requirements. 3. However, questions remain as to whether ComEd's proposed rate design is in accord with the Commission's last rate case Order, the Order in docket 10-0467. Evidence that touches on rate design may be probative this issue or on other issues. 4. Also, discovery cannot be limited to those matters that are probative at trial. Rather, in Illinois, the standard for determining whether a matter is discoverable is whether it is "reasonably calculated to lead to discovery of admissible evidence." (See e.g., Ill. S. Ct. Rule 201, Committee Comments to par. b). There may be evidence that is discoverable here which appears to be related to rate design, but which is probative regarding other issues, or which is reasonably calculated to lead to discovery regarding other issues. Therefore, while we decline to issue the protective order proposed by ComEd, all parties and Staff must be mindful of the language in paragraphs 1-4 above, which should provide some meaningful parameters for discovery going forward.
    We also encourage the parties and Staff to use the traditional discovery dispute methods employed in Illinois, (See, e.g., S. Ct. Rule 201(k), requiring conferences amongst the parties when a discovery dispute arises) or to file the appropriate motions to strike testimony, if necessary. We again remind the parties that we are available to resolve motions to compel or other discovery disputes, if need be, on an emergency basis. Notice served electronically to parties.
