    The Motion to Strike filed by the Illinois Power Agency on May 8, 2012 is hereby granted and attachment B to the brief on exception of Chicago Clean Energy ("CCE") is stricken. Additionally, the text in CCE's brief on exception beginning with the second full paragraph on page 12 ("Any doubt...) and ending with the first full paragraph on page 13 ("This confirms that no...") is also stricken. In essence, CCE has improperly attempted to bolster its position by providing new evidence as an attachment to its brief on exception. Section 200.830(e) of the Commission's Rules of Practice, 83 Ill Admin. Code 200, states "Statements of fact in briefs on exception and replies to briefs on exception should be supported by citation to the record." The above mentioned portions of CCE's brief on exception as well as Attachment B violate Section 200.830(e) and should be stricken. In addition to violating the Commission's rules, failure to strike this material would violate the due process rights of all other parties and would be prejudicial to those parties. While the Chief ALJ makes no finding whether the stricken material would have been appropriate at an earlier point in this proceeding, it is clearly far too late to accept new evidence in this proceeding. When the Commission granted rehearing in this proceeding on February 23, 2012, it specifically cautioned parties about "whether they are proper filings or not, affidavits and things of that nature attached to pleadings at the end of the case." (February 23, 2012 Bench Meeting Minutes at 37-38) Despite the explicit direction from the Commission to "go back and read the rules...so that the Commission has a proper evidentiary record upon which to make their determination..." CCE has, apparently, failed to do so to the detriment of other parties and a fair process. The Chief ALJ, as well as the Commission, has gone to great lengths to treat all parties fairly and to read the rules of practice liberally. At this stage of the proceeding, the material identified above must be stricken. Parties advised electronically.
