Service - Administrative Law Judge Ruling
Notice given that the Administrative Law Judge has completed a review of the application filed by Ecologistics, LLC ("Applicant") on September 14, 2011 and hereby rules that the information described below shall be filed with the Chief Clerk of the Illinois Commerce Commission on or before September 27, 2011. The response to this ruling shall be verified and must be actually received by the date indicated, regardless of whether the response is filed with the Chief Clerk electronically or as hardcopy. Applicant shall also electronically serve a Word version of its response on the Administrative Law Judge (jalbers@icc.illinois.gov) by the date indicated. General Requirements - Paragraph 7 of the application directs an applicant to disclose whether it has had any complaints filed against it for its provision of any services in the electric or gas industry in this or any other jurisdiction. If any complaints have been filed against the applicant, Paragraph 7 directs the applicant to include in its response the nature of the complaint, the jurisdiction, and the ultimate resolution. Applicant has not provided this information in its application. Please provide the missing information. Technical Requirements - 83 Ill. Adm. Code 454.70 provides: a) An applicant shall be deemed to possess sufficient technical capabilities to provide agency, brokering or consulting services if the applicant can demonstrate that it has had experience in the electric industry of at least one year. b) The applicant shall include in its application an exhibit containing occupational background information on the persons who are being used to satisfy the requirements of this Section. There is no information in the application that clearly demonstrates Applicant has persons on its staff with experience in the electric industry of at least one year. Attachment B to the application indicates that Applicant is relying upon Mr. May’s experience as an electrician and/or his experience in the manufacture of LED lighting. Attachment B to the application, however, does not indicate the duration of Mr. May’s experience as an electrician or indicate examples of the work he performed as an electrician. Furthermore, Mr. May’s experience manufacturing LED lighting does not equate to experience in the electric industry. Please provide sufficient information demonstrating that Mr. May, or some other individual on Applicant’s staff, has experience that satisfies the requirements of Section 454.70. The occupational background of any such employee(s) should be provided in compliance with Section 454.70 as well. Notice served electronically to parties.
