Notice given of the following ruling by the Administrative Law Judge pursuant to 83 Ill. Adm. Code 200.875, whereby the Administrative Law Judge hereby issues this post-record data request for certain calculations and numerical analyses: For each water and sewer rate district whose rates would be affected by this proceeding, Aqua Illinois, Inc. ("Aqua") is directed to provide a set of schedules showing the rates, by rate classification, that would result if the conclusions in the Proposed Order regarding operating revenues and expenses, rate base, rate of return, cost of service and rate design were adopted. Aqua is directed to provide a set of schedules, for each water and sewer district, showing a "typical bill" for the residential rate classification under the conclusions contained in the Proposed Order. For each typical bill schedule, Aqua shall identify the typical residential customer usage assumptions used in the calculations. For each existing rate district, the percentage change in the typical residential bill from that applicable under existing rates shall be provided as well. For each of the other rate classifications, Aqua is directed to provide a set of schedules calculating the percentage change in revenues, for each existing rate district, under the conclusions contained in the Proposed Order. At its discretion, Aqua may provide additional schedules showing typical bills for residential customers using relatively low amounts of utility service and relatively high amounts of utility service for each rate district and rate classification. If Aqua elects to provide such additional schedules, it shall identify the assumed usage level in the schedules provided. Other Parties are permitted to provide a response to this ruling containing the calculations and analyses described above. The filing date for all responses to this ruling, and any replies to responses, are January 26, 2012 and February 2, 2012, respectively. All responses and replies thereto shall be verified and filed with the Commission, and shall not exceed the scope of content described above. Notice is hereby given of a ruling by the Administrative Law Judge on the Motion filed by Viscofan USA, Inc. (“Viscofan”) to “Strike Rebuttal Testimony on Rehearing” (“Motion” or “Motion to Strike”) that was filed by the Illinois Commerce Commission Staff (“Staff”) and by the People of the State of Illinois (“Attorney General” or “AG”). Viscofan argues that the testimony it wants stricken is “beyond the scope of rehearing” and is not proper “rebuttal.” On June 4, 2012, Staff and the AG filed responses opposing Viscofan’s Motion. Viscofan filed a reply on June 5, 2012. The motion to strike is hereby denied. As Staff indicates, Viscofan’s rehearing testimony should not be considered in a vacuum, without regard to the ratemaking context or consequences. In fact, as Staff notes, much of the ratemaking context is reflected in Viscofan’s rehearing application. There, in its prayer for relief, Viscofan asks the Commission to “reduc[e] the increase to the Large General Service Rate class.” In support thereof, Viscofan claims the rate approved in the Order does not properly consider Viscofan’s ability to obtain its own water supply and is “no longer economical.” Viscofan relies in part on a statement that “in 2012, [it] developed installation costs and a construction timeline.” Viscofan also comments on the adverse impact its departure would have on the rates paid by existing customers, and it takes issue with Staff’s reliance on cost of service in recommending the rate to be charged to Viscofan. These are issues which come into consideration in determining the appropriate discounted rate to be assessed to Viscofan. Presumably, Viscofan’s rehearing testimony, like the arguments in the rehearing application, is intended to provide support for the relief sought in Viscofan’s rehearing application -- which is to reduce the rate increase applicable to it -- rather than being viewed in isolation. As such, other Parties should have the opportunity to respond. The testimony to which Viscofan objects, whether characterized as rebuttal or something else, is their first opportunity to do so, and is a proper response within the context of the proceeding and the scope of rehearing. If Viscofan wants its rates reduced on rehearing, which could increase rates for other customers, then other Parties should not be prevented from addressing whether Viscofan’s arguments and analysis on rehearing justify such a reduction. It is also observed that even if Viscofan’s position regarding the scope of rehearing testimony were accepted, Mr. Rubin’s testimony about a standby charge would be permissible. Such testimony is in response to Viscofan’s estimate of its cost of providing its own water supply. As indicated above, the Motion to Strike is denied. Parties advised electronically.

Notice given of the following ruling by the Administrative Law Judge pursuant to 83 Ill. Adm. Code 200.875, whereby the Administrative Law Judge hereby issues this post-record data request for certain calculations and numerical analyses: For the water rate district whose rates would be affected, Aqua Illinois, Inc. ("Aqua") is directed to provide a set of schedules showing the rates, by rate classification, that would result if the conclusions in the Proposed Order on Rehearing (“Proposed Order”) were adopted. Aqua is directed to provide a set of schedules showing a "typical bill" for the residential rate classification under the conclusions contained in the Proposed Order. For each typical bill schedule, Aqua shall identify the typical residential customer usage assumptions used in the calculations. The percentage change in the typical residential bill from that applicable under existing rates filed pursuant to the Order entered February 16, 2012 shall be provided as well. For each of the other rate classifications, Aqua is directed to provide a set of schedules calculating the percentage change in revenues under the conclusions contained in the Proposed Order. At its discretion, Aqua may provide additional schedules showing typical bills for residential customers using relatively low amounts of utility service and relatively high amounts of utility service for each rate classification. If Aqua elects to provide such additional schedules, it shall identify the assumed usage level in the schedules provided. Other Parties are permitted to provide a response to this ruling containing the calculations and analyses described above. The filing date for all responses to this ruling, and any replies to responses, are July 30, 2012 and August 3, 2012, respectively. All responses and replies thereto shall be verified and filed with the Commission, and shall not exceed the scope of content described above. Copies thereof shall be served electronically on other Parties and (in Word format) on the Administrative Law Judge by 5:00 P.M. on the date of filing. Notice served electronically to parties.
