    Notice given of the following Administrative Law Judges’ Rulings: 1.) The Motion to Strike filed by the Citizens Utility Board, the Illinois Attorney General and the AARP on August 26, 2010, is granted. We note that Dr. Hewings’ testimony (ComEd Ex. 2.0) is not relevant, in its entirety, as it is not related to whether Commonwealth Edison Company should receive a rate increase or rate-related issues. The economic “ripple effect” that utility expenditures could have is simply not germane to the ultimate issue in a rate proceeding-whether expenditures should be made at all. With regard to the portions of Dr. Andrade’s testimony (ComEd Ex. 3.0) that are the subject of the motion to strike, we agree with the movants’ assertion that whether Commonwealth Edison Company has been “a good corporate citizen,” or, whether its employees have been involved in charitable activities, is not relevant in a rate proceeding. Also, character evidence, which is, essentially, the gist of the testimony that the movants seek to strike, by its very nature, concerns an individual person, not a group of persons (here, Commonwealth Edison Company employees), as, no group of persons can be generally characterized as good or bad. Commonwealth Edison Company has three days from the date of this ruling to file and serve a revised Ex. 3.0. The parties are urged to conform with Illinois law regarding evidence in the future. 2.) Any Reply to Commonwealth Edison Company’s Response to the Petitions seeking Leave to Intervene filed by the Retail Energy Supply Association, and the Illinois Competitive Energy Association, which also concerns the Coalition to Request Equitable Allocation of Costs Together, (“REACT”) filed on September 16, 2010, must be filed and served by Sept 23, 2010. Colton is granted, as follows: This testimony is stricken from page 9, line 181, through page 37, line 834, and stricken again at page 38, line 860, through page 50, line 1205. All other relief requested in that Motion is denied. The Illinois Attorney General has three business days from the date of this ruling to file and serve revised testimony that does not contain the stricken testimony. In so ruling, we note that this Commission is always mindful of any financial burden that a rate increase could impose upon the general public. We shall remain vigilant in imposing only just and reasonable rate upon any customer class and every customer class. We are also especially mindful of the burden that a rate increase would impose on those that can least afford such an increase. However, evidence as the general economic conditions that exist at present is not germane to ComEd’s allegations that it needs to increase its revenue requirement. 2. The Motion filed by ComEd to Preserve the Confidential Designation of Certain Documents is denied. ComEd did not establish that this information is confidential. 3. The Motion to Compel filed by the Coalition to Request Equitable Allocation of Costs Together (“REACT”) is denied, in its entirety. We have reviewed the pertinent “data request” responses and find many of them adequately answered, or, asked in such a manner that appears to request customer-specific information. Customer-specific information is unduly burdensome. However, REACT is not precluded from requesting information in discovery that is not customer-specific regarding the assets used to serve the extra-large load class of ComEd customers.
