Oral Argument is scheduled for Thursday, December 2, 2010 at 2:00 P.M. in Chicago. Commissioners may also participate via videoconference from the Commission’s Springfield offices or by telephone consistent with the Commission’s Rules of Practice. Consistent with Section 200.850(b) of the Rules of Practice, Oral Argument will be limited to parties having filed briefs in these dockets. In addition to the requirements contained in Section 200.850(c) of the Rules of Practice, the Commission herein sets the following additional guidelines: (1) The scope of Oral Argument is as follows:
    a. The appropriate cost-recovery mechanism for the PORCB program and any
    associated cost-recovery methodology issues; b. Whether ComEd should be required to provide a bill insert service to retail electric suppliers; c. The appropriate PORCB program implementation or "go live" date; d. The proper rate of return; and e. The cap on ComEd’s CB Adjustment rate for the First Application Period. (2) Each party presenting Oral Argument will have 15 minutes to present on any or all of the topics listed above. Unless parties have filed joint briefs in these dockets, parties are prohibited from pooling or sharing their time allotment.
    (3) Irrespective of the issues listed above, the parties should be prepared to answer any question regarding the record or the pertinent law. (4) Parties intending to present Oral Arguments must notify Brian Granahan (bgranahan@icc.illinois.gov) and ALJ Sainsot (csainsot@icc.illinois.gov) with a list of attorneys presenting on the matters for Oral Argument by 5:00 p.m. on Tuesday, November 30, 2010.
    (5) Any parties presenting arguments shall provide Mr. Granahan and ALJ Sainsot with exhibits, if any, that will be used for Oral Argument by 5:00 p.m. on Wednesday, December 1, 2010. (6) If an attorney is in need of an accommodation for any visual aid, counsel must inform Mr. Granahan and ALJ Sainsot by 5:00 p.m. on Wednesday, December 1, 2010, as to the specifics of the accommodation needed.     Notice given that pursuant to 83 Ill. Adm. Code 200.875, the Administrative Law Judge hereby issues this post-record data request for certain calculations and numerical analyses. Commonwealth Edison Company ("ComEd") is hereby directed to provide a set of schedules showing an uncollectibles factor calculated in a manner is described in the October 7, 2010 proposed order in this proceeding. Specifically, ComEd is directed to calculate a combined uncollectibles factor residential and commercial customers. The single combined uncollectible factor for residential and commercial customers shall be a weighted average calculated dividing the total uncollectible expense for UCB/POR eligible customers of ComEd by the total revenue of ComEd for UCB/POR eligible customers, using date from the most recently-available calendar year. It is intended that this weighted average uncollectibles factor shall be derived in the manner used by the Commission in Docket Nos. 08-0619 (Ameren’s UCB/POR docket) as shown on Ameren Exhibit filed on December 22, 2008 in that proceeding. A copy of that Exhibit is attached hereto.
    Notice also given that any party other than ComEd may choose to provide a response to this request containing the calculations and analyses described above. The filing date for ComEd and any other party that chooses to respond to this ruling is October 29, 2010, The filing date for any reply to responses is November 4, 2010. All responses and replies thereto shall be verified and filed as an official filing with Chief Clerk of the Commission and all other parties of record to this proceeding. Any party that files a response and/or reply is directed to provide an electronic copy of the response and/or reply to the Administrative Law Judges by 5:00 P.M. on the date the response or reply is due.     Notice given by the Administrative Law Judge that for the reasons stated herein, Staff’s Motion to Strike is granted and ComEd has three business days from the date of this ruling to re-file its Reply Brief. Staff seeks an Order requiring ComEd to strike the following language from its Reply Brief:
    Although Staff attempts to establish increased risk under the Funding Law by citing to a two-year difference between the expected and final maturity dates as “evidence” that “the timing of cost recovery was uncertain even for transition bonds,” this is completely wrong. (Staff Init. Br. at 74.) To the contrary, the expected and final maturity dates are set forth as part of the overall structure of the bonds required to accomplish the AAA rating. In other words, this provision is included to provide assurance to investors in the same way that the segregation of funds and bankruptcy remote trust provisions do. Indeed, Moody’s has explained that "[m]ost stranded cost transactions have a two-year window between the expected and legal final maturities to provide sufficient time to implement a true-up if necessary to adjust for any under collections that arise from volatility in consumption patterns or other unforeseen events." Taimar Jamir, Stranded Costs: A Resilient Asset Class, Moody’s Investor Services, Jan. 3, 2005, at 2. These dates do not reflect a risk that recovery will be incomplete or inadequate. . . . (Emphasis in original). This language is found in ComEd’s Reply Brief at 20. Staff states, essentially, that the argument above is based upon a Moody’s article, both of which, was never part of the record in this case. Staff states that because the facts asserted were not part of the record, Staff was denied the opportunity to cross-examine ComEd’s expert witness regarding this information. ComEd admits that this information is new, but, states that it was merely a citation to a commonly relied-upon secondary source. However, ComEd admits that this article was not attached to its brief, due to Moody’s prohibition regarding reproduction of its proprietary articles. (ComEd Response to Motion to Strike at 3). The case cited by ComEd, In re Marriage of Schmitt, 391 Ill. App. 3d 1010, 1016-17, 909 N.E.2d 221 (2nd Dist. 2009) for its contention that it is proper to cite a secondary source in a brief, concerns secondary sources as to what the law is. In that case, the secondary sources concerned tax laws. (See, also, People v. McKowan, 226 Ill. 2d 245, 273-74, 875 N.E.2d 1029 (2007), a case cited by the Schmitt Court). Moody’s is not a secondary source as to what the law is. Nor does the quotation above otherwise concern what the law is. Notice served electronically to parties.
