Notice given that the Administrative Law Judges have reviewed the responses to the motion made by Commonwealth Edison Company (“ComEd”) seeking entry of a protective order, the motion itself, the reply in support therefore, and have concluded the following: Staff’s arguments, which were not objected to, are reasonable and they are adopted in the attached Order; We agree with the contention presented by the Citizens Utility Board (“CUB”) that every effort should be made to maintain as much public access to public records as is possible. However, the language that CUB proffers contains specific categories, which may not include all of the types of proprietary or confidential information that may be proffered as evidence or during discovery. This language also does not contemplate the possibility that appears to exist here, which is, that confidential or privileged information may be information that belongs to, or is about, entities or persons that are not parties to the instant docket. Therefore, the Order has been modified to include language that should ensure that only confidential or proprietary information is protected by the Protective Order, but, it has been modified in a manner that addresses the concerns stated in the language above.
