    Notice given of the Administrative Law Judge’s ruling regarding oral argument: Instruction (6) contained in the ruling issued December 18, 2009 is modified in the following respect. In all other respects, the previously issued rulings remain in effect: 6. The order for the presentation of oral arguments is as follows:
    The Illinois Power Agency (“IPA”) shall be first to present Oral Argument. The IPA shall have an allotted time of 30 minutes, which it may divide between initial and rebuttal argument. The Commission Staff will then present Oral Argument with an allotted time of 15 minutes.
    Next, the Illinois Attorney General will present Oral Argument with an allotted time of 15 minutes. Wind on the Wires will then present Oral Argument with an allotted time of 15 minutes.
    Next, Commonwealth Edison Company and the Ameren Illinois Utilities will collectively present Oral Argument; the allotted time for both parties combined is 15 minutes; a party may reallocate unused time to the other party. The Illinois Competitive Energy Association will then present Oral Argument; it will have an allotted time of 15 minutes. Parties advised electronically.

    Notice given of the following ruling by the Administrative Law Judge regarding the Illinois Power Agency’s (“IPA’s”) “Motion for Leave to file Supplemental Recommendations for the Procurement Plan” (“Motion”) filed November 9, 2009. Responses by other Parties were filed November 13, 2009. Parties’ replies to responses were filed November 16, 2009.
    The Motion for Leave to file Supplemental Recommendations is granted. The supplemental recommendations are contained in Appendix K to the Motion, and are intended to clarify and modify the IPA’s proposal to procure long-term renewable resources. As observed by the IPA, the Commission is expressly authorized by statute to make modifications to the filed plan. With regard to the IPA’s November 9 filing, which was intended to resolve a number of problems cited in earlier filings, other Parties were afforded an opportunity to file responses to it, as well as replies to responses. It is also noted that the November 9 filing addressed one issue, that being long-term renewables. All things considered, those recommendations contained in the November 9 filing do not constitute a “new plan.” Parties advised electronically.

    Section 16-111.5(d)(3) of the Public Utilities Act, 220 ILCS 5/16-111.5, provides, in part, “Within 5 days after the filing of the procurement plan, any person objecting to the procurement plan shall file an objection with the Commission.” Accordingly, any such “objections” shall be filed on or before October 5, 2009. Such objections shall be in verified form. Copies of objections shall be served electronically on other parties, and (in Word format) on the Administrative Law Judge, on the date of filing.
    With regard to such objections, please note that incorporation by reference of any comments “submitted to the [Illinois Power] Agency” (“IPA”) pursuant to Section 16-111.5(d)(2) is not acceptable.
