Service - Administrative Law Judge Ruling

Notice given by the Administrative Law Judges that this ruling is an attempt to clear up any confusion caused by yesterday’s rulings. Apparently, the Illinois Attorney General and the Citizens Utility Board served two motions, one to consolidate all three dockets, and another to open a remand proceeding in docket 09-0263. The motion to open a remand proceeding, however, was not filed on e-docket. Therefore, if they have not done so already by the time of this ruling, the Illinois Attorney General and the Citizens Utility Board are directed to file such motion. Additionally, the schedule in yesterday’s ruling, which is: Responses are due to this motion by no later than January 21, 2013 and a reply, if any, is due by January 25, 2013, is applicable only to the motion to initiate remand proceedings. However, January 21, 2013 is a state holiday; therefore responses will become due on January 22, 2013. With regard to the motion to consolidate the three dockets, the schedule is as was previously set forth by the parties in dockets 11-0459 and 12-0371. That is, Responses are due to be filed and served by January 25, 2013, and Replies, if any, are due to be filed and served by February 1, 2013. Notice served electronically to parties.

Service - Administrative Law Judge Ruling

Notice given by the Administrative Law Judge that the Motion filed by the Illinois Industrial Energy Consumers (the “IIEC”) seeking leave to file a pleading joining the Response filed by the People of the State of Illinois (the “AG”) is hereby granted. Notice also given by the Administrative Law Judge that the Motion filed by the Commonwealth Edison Company (“ComEd”) seeking leave to file a Supplement to its Petition is hereby granted. The ALJ notes for the record that the AG and the IIEC have objected to the filing of such Supplement. However, the ALJ concludes that the arguments raised concern whether ComEd will be successful on the merits of its Petition, which is appropriately addressed after a trial has taken place; those arguments do not appear to address the legal sufficiency of the Supplement itself. Parties advised electronically.
