The Commission is permitted to take administrative notice of economic conditions and data in its deliberations. We find that the Dow Jones is an appropriate subject for administrative notice. Regarding the statement on page 64 of Nicor Gas’ Reply Brief surrounding the technical report referenced in Mr. Lazare’s direct testimony, we find that Staff’s motion to strike should also be denied.     Notice given that the date for filing Briefs on Exception to the Administrative Law Judge’s Proposed Order is February 25, 2009. Notice also given by the Administrative Law Judges that, pursuant to 83 Ill. Adm. Code 200.975, the Administrative Law Judges hereby issue this post-record data request for certain calculations and numerical analyses. The Northern Illinois Gas Company is directed to provide a set of schedules showing the rates, by rate classification, that would result, if the conclusions in the Proposed Order that issued on February 9, 2009, regarding revenues, operating expenses, rate base, rate of return, cost of service, and rate design were adopted. Notice further given that the Northern Illinois Gas Company is directed to provide a set of schedules, by rate classification, showing a “typical bill” schedule pursuant to the conclusions contained in the Proposed Order. For each “typical bill” schedule, the Northern Illinois Gas Company shall identify, for each rate classification, the typical customer usage assumptions used in the calculations. The percentage change in the “typical bill” under existing rates shall be provided as well. The Northern Illinois Gas Company shall also provide additional schedules showing “typical bills” for customers who use relatively low amounts of utility service and “typical bills” for customers who use relatively high amounts of utility service for each rate classification, with the assumed usage level for these schedules. Notice further given that any party other than the Northern Illinois Gas Company may choose to provide a response to this ruling containing the calculations and analyses described above. The filing and service date for all responses to this ruling is February 17, 2009. The filing and service date for any replies is February 20, 2009. All filings shall be served on the Administrative Law Judges no later than 5:00 P.M. All filings shall be verified. Parties advised electronically.

The Administrative Law Judges note that the testimony at issue in both motions is, in substance, identical. The Administrative Law Judges also note that currently, Progressive Energy Group is not doing business in Illinois. (See docket 08-0478, Progressive Energy Group, LLC, Application for Certificate of Service Authority, Response of Progressive to ALJ’s Request for Information, at p. 2).
    Notice is also given that leave to intervene is hereby granted to CEAFUR; however, we cannot permit Progressive Energy Group to participate in this docket as a part of CEAFUR until it establishes that it has standing to participate in this proceeding. Notice further given that leave to file testimony instanter is hereby granted to CEAFUR. Leave to file testimony instanter is hereby denied to Progressive Energy Group, as this issue has now become moot. However, the purpose of prefiling testimony is to provide opposing parties with advanced notice of the substance of a witness' testimony. Therefore, the ruling allowing CEAFUR to file testimony allows it to participate in discovery. It has no other effect. Parties advised electronically.
