This same issue is already being litigated in this docket with respect to the later PGA years. Accordingly, administrative efficiency stands in favor of denying the motion. If the Commission cannot address this issue in this proceeding, it would be required to re-open and consider the issue in a 1999 docket, which pre-dates the Commission’s e-docket system. Depending on the resolution of this issue, the 1999 and 2000 PGA dockets could be re-opened for the limited purpose of incorporating the conclusions found here into the record of those earlier dockets. Although Nicor asserts that the ALJs previously granted a similar motion (in 2004), we note that much has occurred since that ruling and, in fact, Nicor withdrew all its previous testimony, which necessitated Staff’s filing of new testimony.
